In posting this topic I am conscious that I am leaving myself open to the supercilious scribblers who consistently soil this excellent forum with gratuitous and contrary annotations. I shall however lay my head on the butchers block in the hope that somebody out there can proffer a modicum of constructive advice.

My problem regards my daughter. She was born in Europe and has been living here in Thailand with me for 7 of her 8 years. Her deranged birth mother has not made any attempt to contact her daughter in all of this time. The child speaks Thai fluently and 2 years ago the Thai Children’s Court approved that my Thai girl friend of 8 years be registered as her adopted mother. The Court system in my own country made me her legal guardian within 6 weeks of her birth as they feared for the child’s safety.

I want to apply for a Thai passport for her which I am informed is possible but while I have the Thai Judges support I suspect that I need additional assistance and in particular a Thai legal mind with compassion and connections. A passport from the country of her birth is of course possible but her malicious birth mother refuses to sign the necessary papers without a substantial financial recompense.

Please anybody out there know somebody who could take this case on for me?

I'm not an expert on custody issues. Others may be able to help you on that.

But, lets start with the basics. If she was born outside of Thailand, she'll also need a Thai birth certificate issued by the Royal Thai embassy (in addition to the one issued by the country your daughter was born in). Normally, to get one issued, the nationality of the thai parent will need to be established. The thai BC will obviously state that your daughter is Thai, and with this, a passport can be aquired.

I do not know what documentation you have from your daughters mother (copies of her PP, house registration for instance), but if you have custody in your home country (and again, I am no expert) you may want to speak to the Thai embassy there to see what they can do in such a situation where you (may) have documents to establish her Thai nationality but where the mothers signature is not forthcoming. Alternatively, with the court order, you daughters new step mothers bonafides may be all that are required.

The important point being, that the only real way, for a child an overseas born Thai to begin the process of getting a Thai passport, is to get a BC from the Thai embassy in the country of birth as a starting point (Thai BC's are different for those who are born outside of Thailand, and there is no real way to have one issued to you by your local Ampur in Thailand). The passport then follows.

The OP doesn't mention whether the birth mother is Thai or not (or maybe I don't read the post correctly). Wouldn't that make a difference?

good point. I simply assumed that the birth mum was Thai, which is a key point. If she wasn't, then the RTE will not issue a BC based on the fact that neither of the birth parents were Thai. This much I know.

Having said that, if the Thai court has made a ruling on the status of the new adopted mother, then it may be an option worth expoloring. This latter point, is pure speculation on my behalf, just for the record.

Since your Thai girlfriend is your child's adoptive mother, she can proceed with applying for Thai citizenship. She should contact the Special Branch of the Thai police to advise how to proceed with the application, which will go through the interior ministry.
