i m here with student visa

have been overstaying for nearly 6 month (end of this month)

reason: cant pay school (university) because of finical situation, so school doesnt extends my visa. and i was waitin for money from back home for school. and overstay got to over 5 month.

i m planing to leave from don mueng end of this week.

want to know:

is the max fine 20k thb? (for sure? not a single bit more)

if its is 20k fine, can it be lowered?

what steps should i take in don mueng airport? say nothin, go to check-in, go to the gate where they check passport and pay fine?

anything else i should know?

tips? advice?

Best thing you can do is phone a friend or family member to wire you the 20k before going to the airport, or at least borrow it from someone ASAP. They are not going to lower the fine. If you front up and pay the fine, they will let you leave. If you go to the airport without the 20k, they will detain you in the IDC (which is horrendous) until you can come up with the cash.

You do not want to be detained at the airport detention centre so do not go to the airport without 20,000 baht.

It is 20k, pay the fine at the airport.

But you're still at risk every day you're not flying out.

If immigration knocks on your door because of your overstay you will end up in jail. The longer you wait...

Overstayed more than 90 days – 1 year ban from Thailand

Overstayed more than 1 year – 3 year ban from Thailand

Overstayed more than 3 years – 5 year ban from Thailand

Overstayed more than 5 years – 10 year ban from Thailand

Overstayed less than 1 year but apprehended and arrested – 5 year ban from Thailand

Overstayed more than one year but apprehended and arrested – 10 year ban from Thailand

If you are arrested by immigration for overstaying your visa, the penalty is far worse. It is likely that you will be taken to an immigration detention centre. After this, you will be subject to the following ban:

Overstay less than  1 Year  –   5 year ban from Thailand

Overstay more than  1 Year – 10 year ban from Thailand

Another strange post from me. Just want thank the 3 guys above post such helpful info to the OP.

My patience bit less. Must be age.

So OP, You have best advice above.

Keep head down till airport. Assume Bangkok airports, I personally would take public transportation. Swamy has train link under airport and DM has airport A1 bus.

When you leave, there is no legal way of avoiding blacklisting. Besides the 20,000 baht fine (you do not want to know how this might be reduced, trust me) the blacklisting is a 100% certainty if leaving from Don Muang. Especially if you are not wealthy, plan on being away from Thailand for the next 12 months.

Tim...just for the forum, do you have any knowledge of what happens after blacklisting. Meaning let's say he was given the 12 month, is there a way to check if your A OK to return.

As I understand it, from threads on here or other sites, there is a central database in Immi and if you're not sure you can get a lawyer to check. Would seem a waste of time and money, just add the date to calendar it's due to expire ????

thank u guys for the quick response

It's not just the fine alone, you will also be banned for 1 year from entering Thailand again.

If you are caught, then it is worse.

Yes. It’s the limit allowed by law.

No. Unless you get your self arrested and prosecuted through the court. Then the fine will be closer to 5K.

When you hand your passport to the IO at passport control they will send you to the overstay desk as soon as they see the overstay.

You’ll get an overstay stamp in your passport confirming how long you overstayed and the fine paid. And the should issue a written notice confirming a 1 year ban.

It’s very straightforward.

For the 3-day overstay I once had, the de-tour to the Overstay Desk after presenting my passport at Immigration, took approx 10 minutes (paid the fine and got the overstay-stamp in my passport).

In your case I would reckon it will take somewhat longer, so better don't arrive last-minute at the Airport and risking to miss your flight.

All previous comments on fines etc seem to be correct. I would keep a very low profile until you pitch up at the airport ( with the 20k). You do not want to get apprehended for overstay.

Surprised you let the situation run to six months though.

Anyway best of luck.

I do not know how this is handled administratively. In theory, the blacklisting ought to automatically expire at the end of the blacklisting period. I am pretty sure that if you arrive at a crossing point, and the system indicates you are still banned, it would be possible to resolve the problem and (in principle) be allowed to enter. A big problem can be the advance passenger information system the airlines use to communicate with immigration. It is possible immigration might send back a "do not board" instruction to the airline, which comes with no reason or possibility to appeal. If worried about this possibility, maybe you should fly to a neighbouring country, and enter by land.

I left at Savanbhumi airport in January after a 7 month overstay. 20k fine and 1 year ban. They give you a letter stating 1 year ban. No hassles and took about 25 minutes.

Don't over think things or worry unduly.

Just rock up a good few hrs before your flight no need to worry your not the first and won't be the last. Immigration aren't the devil's most make them out to be.

Smile and go with the flow
