7 Weeks Left for "Border Run" on Non-O-What to do?

Perhaps go stay somewhere else, stay for few days and with proof you are staying there and try at the office there.

Or call 1178 and register a complaint.

I also thought that would be our right. Hard to understand that the one Immigration told him that he's staying with his wife.

 

   That's something annoying, each office has their own rules.

My immigration office told me that i'm NOT visiting my wife but living with her so i cannot have the 60 day extension (for visiting). They were very rude, very abrupt and couldn't care any less about what i said about the rules. Leave the Country or we will deport you !

Immigration is going to adjust things so people who are living or staying in Thailand or the tourists can get their visas extended. Perhaps they will not help the ones they deem are abusing the tourist visa system, by staying and living in Thailand on those. That is something they had coming a long time, though. Just my belief, and not happy to deliver it.

Two suggestions:

1 - Go to your IO again and re-apply.  It's well possible that another immigration officer will simply process your application.  If not, you could while being seated in front of the officer take out a notepad and politely ask for his/her name and start writing it down.  Even better if there is a desk-plaque with the officer's name/rank and start writing it down.  Almost surely you will get the reaction 'What are you doing?'.  Tell him/her that you will be making a complaint to IO Headquarters that the IO is not following the rules/regulations.  If it is a lower rank desk-officer that's the last thing that he/she will want, and your application might get grudgingly 'this is last time' approved.  If still no response, you can - seated at his/her desk - take out your mobile phone and call 1198 - the IO Helpdesk, explain the situation and tell Helpdesk you are sitting at the desk right now and ask them to talk to the reluctant desk-officer. 

Standing your ground doesn't bring you in trouble, but will actually gain their respect (provided that you do it calmly and politely).

2 - If you are not able to convince them to process your application, you could go to a nearby province and check-in at an Hotel/guesthouse.   Ask them to provide you with a print-out of the on-line TM30 they are supposed to file, when you - a foreigner - is staying at their premises. Next day (or maybe better wait one more day) - before being checked-out - visit the IO of that other province (bringing the print-out of the Hotel TM30 with you).  Chances are your application will be processed without any questions asked. 

In case they ask why you apply at their IO and not at the IO of the province where you are staying with your wife, tell them that you are visiting relatives for a couple of days and don't want to return just for doing the application when it can be done there too.

>> Not 100% sure if those suggestions would work, but you have little to lose trying.

Alternatively you could contact your embassy and ask them to send you a letter that you cannot exit the country due to corona-virus restrictions.  With that letter, your local IO will provide you with a 30-day extension of stay (or shorter - 7 days being the minimum they are obliged to provide you). 

Whatever you do, don't go on overstay as that will not only invoke a fine later, but will haunt you in future applications.

Thanks for the advice, but ... I got there 10 mins before the doors opened. No one else there (farang) at the time of opening. The head of the IO was stood there and asked me what i wanted. I showed her the form filled out for the 60 day extension plus relevant paperwork. She then proceeded to tell me i was not entitled to it and why, very loud and made sure all the other immigration officers were watching. I then explained that i had checked their website rules and that i was entitled to it. She couldn't have cared an less and continued to tell me i was not entitled to it. Another immigration officer then walked up with an arrest warrant post dated to the date after my 90 day ran out with my picture on the top and a map to my house at the bottom. He spoke to my wife then she said "just go" and pushed my outside. She explained what he had said, i programmed my sat-nav and drove to the border. another 90 days.

If the borders are open when it runs out i'm not even going to try and get the 60 days at my IO.

 

The problem is that ever IO has their own take on the rules !

Wow, with such response by the Lady-Boss you obviously have no choice but to let go.

And lucky you still managed to do a border-run in these corona-times.

The nice thing about the 1-year ME Non Imm O Visa is that you can get 15-month IO hassle-free long stay out of it, which in your case is a Godsend with your friendly IO.

Which Border and when just out of interest?, as the vast majority are closed, or you need a visa to enter which would not be possible if you drove straight there.

This thread has been super helpful, thank you everyone who contributed. I have a couple of questions.

 

I have a NON Immigrant - O marriage to Thai national that expires in August 15, 2020.

Currently I also have a stamp on my passport that say I can stay until May 1, 2020. (I entered Thailand Feb 1)

 

1. Say on April 10, I go do a 60 day extension. Does that mean I can stay an additional 60 days from May 1? Or is it 60 days from April 10?

 

2. Say 60 days from May 1 is July 1. On July 1, I fly out of the country and re-enter Thailand July 2. I then get a 90 days stamp to stay until Oct 2nd? Does that mean I can stay in Thailand until Oct 2nd, past my Visa expiration of August 15th?

 

I hope this is not confusing to read...thanks for your help!

1. Yes, you can apply for a 60-day extension for visiting your thai wife, but most probably they would not be willing to already provide it on April 10, and you would have to wait till approx last week before your expiry of permission to stay to do the application.  The 60 days will be added to your May 1 permission to stay expiry date, so till June 30. 

2. Yes, re-entering Thailand before your 1-year Non Imm O Visa validity date has expired, will provide you with a 90-day permission to stay (which can also be extended by 60 days).  So you can squeeze almost 17 months out of the 1-year Non Imm O - marriage Visa, when re-entering just before Visa validity expiry.

If these guys are not following the rules I would really love to know if complaining as previously mentioned to 1178 would have any effect. Normally I doubt it but these are unusual circumstances. Also what border run did you do? I thought it said somewhere in the thread savvanakhet was not an option now?

Thank you for your help! I have an interesting question re paperwork needed to do the 60 day extension. Per this page https://www.thethailandlife.com/non-immigrant-visa-extend-stay-60-days says that I need a house certificate signed by me.

 

"House certificate / copy of lease agreement at the condo you stay in. (Take the original if you have it). If this is your condo lease agreement, it must have your signature and the owners signature on it. A piece of paper stating your address, the deposit you paid and the amount you pay each month is not enough. It must be a proper agreement."

 

I rented a condo when I was in the US through my wife's cousin who found the condo and signed the lease for us. I just give her cash every month and she's the one that pays the rent. How do I go about fulfilling this requirement? Is it a must have?

I would also make sure that a TM-30 has been filed from the place where you are staying, as such filing confirms you are staying at that address.
