Hi again,

 

Asking for a friend.

He and his family have a dutch passport.

They all live(d) in BKK.

He was on retirement visa and his wife on a Non-O guardian visa (500k) in her account.

Son was in boarding school in UK

Daughter in private school in BKK

 

He travelled last week to Vietnam where he will work for an international company. Now hi is doing his 2 weeks quarantine.

 

Daughter is now in UK  boarding school.

Son is since march back in Thailand because of school closure in UK.

 

Wife and son can't follow him yet to Vietnam because he has first to get his work permit for Vietnam.

 

They must find a solution for son and wife to enable them to stay until November this year in Thailand and bu then, all should be sorted

that they can join him in Vietnam end of November.

 

Any thoughts?

When does his wife's extension of stay expire (I don't think she was on 90 day visa entry).

If son is under 15 years old there is no overstay fine when he leaves the country and no banning from entry until he is 18.

Wife is on guardian visa which expires on 18th of November but her daughter went already to UK boarding school in August.

Son who is studying in UK came in on tourist visa as schools in UK closed. Tourist visa was valid until 26th September and since/amnesty.

Son must sit an exam in Thailand in November.

 

Looking for possibility to stay until 3rd week November and then, hopefully work visa for friend is sorted and wife and son can join him in Vietnam.

Unless somebody tells immigration that her daughter left her extension it will not be canceled.

If attending school he may be able to apply for a non immigrant visa for attending school that will be valid for 90 days.

I just spoke to my friend in Vietnam. His wife's guardian visa is valid until 18th of November. Should be fine.

He came on a 30 day tourist visa waiver. He never re-newed or extended anything. Amnesty. They are now scared that son will be in trouble. Perfect solution would be to get the possibility to stay until mid November and then go with his mother to Vietnam.

His permit to stay and etc should of been taken care of long ago as soon as he started studying at the University.

He could of applied for a 90 day non immigrant visa entry (category ED) and then a one year extension.

His only choice now is to get a letter from their embassy and apply for a 30 day extension. After getting that with help from the university he could apply for the 90 day non immigrant visa entry.

Probably I did not make it clear.

 

He did his IB in the UK. Boarding school in UK closed in march and he came back to his family in BKK.

He applied to enter University in UK for the year 20-21 but now takes a gap year.

He never studied in Thailand . The last 2 years, he was doing his IB in the UK and now taking a gap year because of the IB mess-up.

If he did not apply for the 30 day extension of his 30 day entry he may be able to apply for it now at some immigration offices.

As mentioned before, he is not British, he is a Dutch pass holder.

UK was just for his studies.

They told me, that Dutch embassy won't give any letter.

They should check again since some embassies have changed recently.
