Jails and police stations are two separate places 

Only a Judge can send a person to jail , the police cannot take a person to jail and this guy didnt even get prosecuted and he will not have a criminal record stating he spent two days in jail .

Jail and prison are often used interchangeably as places of confinement. If you want to be specific jail can be used to describe a place for those awaiting trial or held for minor crimes, whereas prison describes a place for convicted criminals of serious crimes.

    The "resort" shot them self in the foot big-time????. Reading this story, who in the world would pick this place over 100s of others? 

  • The resort has raised it’s rates to make up for the lost revenue.

I love how people are trying to justify what the resort did just because the guest, apparently, acted like a jerk and was dishonest.

The long and short of it is the resort knew full well the local laws and the fact that the guest risked prison. And they still went ahead with the criminal charges. That's a major a-hole move if I ever saw one.

The least Trip Advisor could do is warn any prospective guests. Well done.

TripAdvisor is only earning potential travellers that A person spent time in jail for posting a bad review.

   He didnt get sent to jail . 

He didnt receive a jail sentance for his review 

He was held at a police station for two days and then released without charge , he didnt go anywhere near a jail

The recurring word that stands out in the first 5 searches on Google is the word 'jail'. That's because he was jailed. 

By the way, if you want to visit the Sea View Resort and Spa Koh Chang in the middle of December, we randomly chose a date on Bookings.com and found a room for 2,900 baht a night. Have a great time, but don’t argue about the corkage!

 

Give me 2,900 baht a night, I would not stay at them ..... I hope this hotel will go to hell!

After he made bail he was released from jail, yes.

  Yes, but before the Oct 6 court hearing , he got released without charge after making a settlement with the hotel

True ... but I do note a large difference in Thai law and slander/libel law in those other countries.

Forget it. Thais will not understand how sick their draconian laws (and treatment of inmates) are regarded in the rest of the world. They can benchmark themselves with Saudi Arabia, but that is as good as it gets. In this respect, lovely Thailand is 500 years behind the rest of the civilised world ...... .
Let's make it easy: Stay away from this hotel and refer to this case if u write a (negative) comment on Trip Advisor.

Fritssinkkink hit the nail on the head. I usually avoid any comments here, because as he says "dumb comments as usual.".  Too many idle farang with nothing better to do.  The reviewer does have a conviction for aggressive and illegal behaviour with restaurants/hotels and it does give an indication of the type of character he is. Full marks to the hotel and no accolades to Tripadvisor for adding fuel to the fire with their snarky warning.  Highly unprofessional.

I see this story is now running on the BBC website, whatever the truth of the matter, this hasn't done the resort any favours. The motto "The customer is always right" is clearly the better path. 

The resort should sue trip adviser ???? Tripadviser should not be allowed in Thailand it is BS review site. They should give a general warning for Thailand but not single out this resort.They  are there for their own interests only, nothing to do with real and honest reviews. They US guy was way out of line and it serves him well.

   Yes, I think that warning was also a warning to other businesses in Thailand *If you prosecute any reviewers , we will place this on your TA page* , which will discourage any more prosecutions
