Hi everyone,

 

I will be finishing my current fixed-term contract with my employer (BOI-approved company) at the end of this year (31 Dec 2020).

 

If my research is correct, I need to somehow get a marriage visa before my company goes to immigration and cancel my work permit.

 

My question is, if my company cancel the work permit, and I have not got the marriage visa yet, what are my options? I hold an Australian passport.

You will not need or be able to apply for a visa at immigration.

You can change the reason for current extension of stay to one based upon marriage if you have 400k baht in a Thai bank or proof of 40k baht income.

Ask your employer to do the cancelation for your extension a few days before you job ends so that is postdated to that day. Doing that would give you time to apply for the one year extension at different office if needed.

Where will you be applying for the extension of stay based upon marriage?

Hi ubonjoe,

 

Sorry I forgot to mention. I do have re-entry permit until Feb 2022, which I assume will be cancelled when my company notify the immigration about my end of contract.

 

Yes I do have 400k in a Thai bank account. 

 

I can attend the Chonburi Immigration (which have One Stop Service) or the Pattaya (Chonburi) Immigration. I live in Chon Buri. 

 

Sorry I'm confused about asking the employer to cancel the extension a few days before my job ends. Can I not apply first and then the employer cancel?

You could apply for the new extension on the same day the your current extension is canceled.

I was wring about post dating the cancelation in case you had to do the new extension at a different office. Also it would be good if it was not canceled on the same day you apply for a new one incase you needed addition document for the application.

Immigration will not accept your application for a new extension until your current one is cancelled. The will accept the application prior to date of cancellation and start your new extension on the day it is cancelled if it is only a few days.

Ah okay I understand. I will start the application a few days before my contract finishes. My company is willing to support with the documentation as required or to cancel at the same time I submit my application.
