No, I wasnt suggesting that there was a Court ruling . The threat was made by Police . In addition, everyone should know that it’s a court that rules jail. If he really believed he wasn’t at fault, why didn’t he call his lawyer?

His personal friend posted in this thread and gave the info . Rather than getting lawyers involved and going through a Court case , and potentially spending time in jail on remand awaiting the Court case , he decided to pay up and get it over and done with

I honestly cannot find it. teacherclaire
The Thai lady said that unbeknown to her, her mother had wheeled away her trolley and she thought the one with items belonging to the foreigner was hers. She was wheeling it to an ATM when she was attacked. She was kicked once in the left leg, wai-ed in apology then was kicked in the other leg. The attack happened on December 26th at the Big C Supercenter in Warin Chamrap, Ubon Ratchathani. The first friends in Ubon don't do anything if they don't get paid for their hard work. And that's not hearsay. Perhaps Santa skipped him this year and his stockings were empty?

How did you verify that he was really a friend you take everything he says for true while disregarding the article. He said 6000 bt groceries. The trolley does not look like it holds that much only a few bags. Also it talks about a daughter while on CCTV and in the article no daughter is mentioned (its possible of course). But you seem to give a lot of credence to a poster who after this has no longer posted in the topic. Also you can settle things out of court in other places if you dont want to press charges for assault they are not pressed if injuries are not huge. So its possible in other countries too. The guy just did not want to go to court and risk it. Because what he did was wrong.

Now you've of course moved the goalpost, typical. Originally it was after being charged, which I responded to. Now it's before being charged. As for your main point, avoiding a court case, yes. The prosecutors in Western countries can drop charges at request of the victim even without any large amount of money being paid, and they do. They may also not bring charges if they feel they are unwarranted. As so often, some supposed exclusively "Thai" practice is to be found in Western countries as well, but our posters have just never been able to notice it there. Why's that? She took his trolley which had his belongings in it , whether it was a genuine mistake or deliberate theft is unknown . She then ran off with the trolley after being asked to stop , maybe she was running to get away with the theft or she was running because she thought a felang was chasing her , who knows ? Looks like the felang kicked/pushed her to get her to stop , from the photo the marks look like it was from a collision with a trolley , rather than from the actual kick . She and the police colluded to get a payout , Pay the money or go to jail . That is extortion . Yes, I dont think that he should have touched her , but I also think she shouldnt have used that to extort him . Kicking someone - Wrong Extortion - Wrong

Its not extortion its a settlement. If he did not like the amount go to court. She ran after a big foreigner came chasing after her shouting (how good was her english). If some big Thai runs at me shouting in Thai i might run too. She was in eyesight of the guy so it was not that much of a chase and obviously he caught up with her and at that point just grabbing the trolley was enough (look at his size and her size). Kicking was over the top as you also agree. That is what he paid for. Not extortion just paying for his over the top reaction. IF he did not like it then he could go to court.

robblok
I would probably have paid too just to avoid the hassle with the court. Its a big amount of money but going to court is far worse. I value my time and value peace of mind. He did too. For other people the amount might have been to high and they could have opted for court. Nobody denied him court. The police might have scared him into the settlement but that is how the police works. They want out of court settlements its less work for them. However if you want to go to court there is nothing they can do.
