Exactly, but in the grand scheme of TIT, what really is the difference from the PDRC 8 being released on bail as they were convicted already but are appealing the verdict.  This police officer, although he did commit a major injury by shooting his gun off in a drunken stupor, has not even had a trial yet, and is not considered guilty until convicted.

Maybe not considered guilty [yet] in the crime he obviously committed... but certainly a risk to the public.

I do 100% agree.  However, do they not allow bail for a drunk driver who runs over and kills members of the public?  Yet the student protesters are denied bail while the former pro junta PDRC 8 are freed on bail after being convicted and jailed.  This is the only country I know of where you can appeal your conviction from outside of jail while on bail.

Yes, justice in this country seems to work in reverse to others... petty crime go straight to jail

commit a heinous crime or with connections get bail or pardoned.

The two most important factors in granting bail are:

(1) Is the suspect a flight risk? If so, bail should be denied, or the bail amount should be set extremely high as to eliminate the risk of flight.

(2) Does releasing the suspect put the public at risk? Is there any risk of the suspect committing the same or similar crime again?

 

It seems the judicial system has failed on both points above.

 

Bingo, from memory in my time as a magistrate in the UK there were 5 main conditions that have to be met for a defendant to be granted bail, the two you have mentioned plus "the seriousness of the crime", the possibility of "intimidating witnesses" and the "weight of evidence"

 

This defendant would never achieve bail in the real world, Thailand's judiciary is either incompetent or corrupt or maybe their just different.
