I've a baby due in the next couple of weeks and we even talked about marriage before she fell pregnant so it will come back on the agenda and I am all for that. I just wonder what the best situation is visa wise going forward.

Currently I have a business visa good through April 2008 (plus 90 days).

I could get another WP on this visa but things are getting more demanding with checks etc.

What I am looking for is the easiest way to get a visa and remain here.

Am I right in understanding that the 1 year extension based on 400k is being / has been phased out ?

What is the story with the 40k per month in layman's terms ?

So my wife earns 40k and I earn nothing, so what do I do to get my visa ?

Does this 40k have to be tax paid on 40k ?

How long does this have to have been in place before I apply for a visa on her income ?

Presumably I would still need the 50k+ for a permit and thus could not work for 40k ?

Has anyone worked through this situation in their head and come to a decision ? It seems easy enough but I've not heard of anyone doing it in practice.

I was just going to do another WP but I thought it might be easier and cheaper to just do the 40k route. Even flying back to the UK once a year is a demanding thing, a waste of cash and means that I would have to do 90 day visa runs.

From my experience getting married, even with your wife's advancd state of pregnancy is not particularly difficult!  It took me about 2-3 days of running around.   Once you have a Thai marriage certificate in hand and if you both have a combined family taxed income of 40,000 baht, you may apply for a 1 year extension of visa.  It also helps to have a child in the equation.

Tax records for the past 3-6 months should be enough.

Yes the 400 k things is gone with the wind since October 2006!

I believe the current requirement is the previous years tax return paperwork for Thai money, rather than just a few months.

Are you sure a work permit requires 50k income? I believe that was probably for one year extensions of stay for your nationality. After marriage you can use the 40k and extend one year for family so you would not have to meet the employment income requirements for that.

At the moment I've a business visa but if I can get on the back of my wife earning 40k per month then that would be cheaper. She doesn't pay any taxes at the moment but I think the taxes on 40k per month are about 3.5k per month.

The thing is, if they were to accept that, how long would she have to pay this tax for ? A year is ridiculous.

Your wife will have to pay tax on her personal income as long as Thai tax laws say that a person with that income has to pay tax.
