Judge Chutkan unseals Jack Smith filing alleging new Trump witness intimidation

 

The filing, which was made last week by prosecutors, was known for several days to involve "extrajudicial statements" by the former president. It alleges that Trump's "inflammatory" statements have led to "threats and harassment" against people in the case, and that he "will continue to make similar personal attacks, knowing that they may prompt similar harassment."

 

However, the government requested that the names of the people targeted and the specific threats that were made be redacted from the version released to the public.

 

Specifically, the government is seeking the relief that the Court "enter a narrowly tailored order pursuant to Local Criminal Rule 57.7(c) that restricts certain prejudicial extrajudicial statements; and enter an order through which the Court can ensure that if either party conducts a jury study involving contact with the citizens of this District, the jury study is conducted in a way that will not prejudice the venire."

Trump is clearly doing whatever he can to delay the trial. But, it's unlikely that he will have much success.

 

Bottom line: by Labor Day of next year, Trump will likely be convicted and out on appeal. Not a good look for a presidential candidate.

Fewer than 1% of federal criminal defendants were acquitted in 2022

 

The unprecedented charges against Trump and his subsequent plea raise the question: How common is it for defendants in federal criminal cases to plead not guilty, go to trial and ultimately be acquitted?

 

In fiscal year 2022, only 290 of 71,954 defendants in federal criminal cases – about 0.4% – went to trial and were acquitted, according to a Pew Research Center analysis of the latest available statistics from the federal judiciary. Another 1,379 went to trial and were found guilty (1.9%).

Trump asked another Federal Judge last July to revive the defamation case that he had brought against Hilary Clinton, James Comey and 30 others for triggering the Russia Collusion investigation, due to the revelations of the Durham Report released in May.

 

On Friday, the Judge handed down a scathing order dismissing the motion and denying that there was any new evidence from the Durham Report.

Judge in Trump’s federal election-fraud case won’t step aside

The judge overseeing the federal government’s criminal prosecution of former President Donald Trump over his actions to subvert the 2020 presidential election has turned down Trump’s attempt to get her off the case.

In a 20-page ruling issued Wednesday evening, U.S. District Court Judge Tanya Chutkan rejected Trump’s arguments that her comments in other Jan. 6-related cases raised doubts about her fairness.
