Trump on trial: What to watch for in the second E. Jean Carroll defamation case

This trial is very educational in highlighting the differences between state and Federal courts.

 

Despite all the Trump fluffer yammering about persecution of Trump, this trial is about whether Trump can control himself, both in court, and in the real world, where he must stop from defaming Ms. Carroll.

 

Spoiler alert: he can't, because he's a mental case.

In a filing last month, Carroll's attorneys sought to amend the earlier lawsuit to add a new defamation claim after Trump trashed her as a “wack job” at a CNN town hall after the verdict last month.

 

The proposed amended suit also changed mentions of "rape" to "sexual abuse" or "sexual assault." Trump's filing notes the amended complaint removed 71 uses of the word "rape."

 

Trump lawyer Alina Habba said in a statement that Carroll was trying to "retrofit" her lawsuit "while blatantly ignoring the portion that undermines the viability of her claim."

"Faced with the Carroll II jury's rejection of her rape accusation, Ms. Carroll now seeks to remove nearly every reference of the word 'rape' in her complaint and abandon the narrative she has conveyed to the public for years," Habba said.

And the lawsuit is for ‘defamation’.

 

Trump defamed Carroll intront of camera within hours of losin the first case.

 

His ranting in court this week is an indication of how things are going.

So if Judge Kaplan said in the above link that 'rape' is any forcible penetration, why did the Carroll team have to make 70+ amendments to their original complaint from "rape" to "sexual assault"?

I have no idea whatsoever, which is almost certainly as much an idea as you do.

 

The trial is examining Trump’s later defamation of Carroll, which he has continued to do in the court room, while Carroll is on the witness stand giving her testimony, and significantly in earshot of the jury.

 

The jury gets to decide if Trump defamed Carroll, the same jury that have witnessed him do exactly that  in the court room.

 

Tell us again how Trump is getting away with it all.

I certainly expect he will lose this round. 

 

And as per Jamie Foxx, I have looked at the files when available of a lot of these high-profile NY State victims cases especially the one-off cases
