A mate of mine is aged in 40s. He told me an 18 year old is interested in him. In western countries I think this is not a problem. But here I wasn't sure. I told him I thought it was 20 years old. 

 

If he got involved with this girl and it went pear shaped is he in a spot of bother? He has checked her id card. She is 100% 18 yrs old. 

 

Not interested in moral opinions, only legal. 

How would he prove consent?

For sex 18yo is legal with other adults.

In Thailand the age of consent is set at 15 years old.

As far as I know sex is legal.

Prostitution is not legal under 20 - apart from the fact that it is anyhow illegal.

So, whatever it is that draws her to him, make sure it can't be called prostitution.

 

Personally, I would doublecheck why she is interested. Maybe she has problems with her parents, and she is happy with him. Possible.

But maybe it's a setup to get money maybe sometime later. Be careful!

As far as I know there is some condition that the parents can complain, as far as I know if she is below 18. But maybe it is if she is below 20. Better check!

Duh.  An ID card doesn't provide "evidence of consent", it just confirms a person's age.

There was more than just the age of consent for sexual activities in those cases you refer to.

A 40+ year old Western man thinking it’s a good idea to start a romantic/sexual relationship with a teenager from Southeast Asia. Aside from any concerns about any legal issues, what else could possibly ever go wrong? Wait, never mind, I know, she’s special and different! 

Find a 21 year old and problems solved. No lack of girls in Thailand looking for the big and the small thing.

If I give a girl money to have sex with me, that on it's own is not illegal by either party.  

Sections 5-14 of the Prevention and Suppression of Prostitution Act 1996 explains the offences under that Act.

 

The age restrictions for working in a go-go bar do not indicate the age of consent, it indicates the minimum age for working there.  The minimum legal age to enter a bar or club is also 20.  Girls working in go-go bars are (officially, anyway) not providing sexual services in the bar, that would make those go-go bars brothels. That some girls may do, illegally and on the quiet, is beside the point and no go-go bar manager/owner would ever publicly admit that sexual activities take place on their premises.

Different food, different religion, different language, different levels of education, different levels of intellectuality, different family values, different agendas, different generations, etc. No, never mind, your totally right, two people of similar age and background would surely pose a much lower chance of success.

You need to to understand that Thai law makes a distinction between laws regulating sexual activity, as outlined in the Penal Code, and laws governing marriage and family matters, detailed in the Civil and Commercial Code. The legal age for consenting to sexual activities is set at 15. Legal adulthood, on the other hand, is acknowledged from the age of 20 onward. While the minimum age for marriage consent is established at 17.

Under 21s are still not classed as an adult for many things.

 

19 yo son-in-law had to get both his parents permission for new Thai passport, for example.

 

So personal choices of age of sexual partner aside, if under 21 you are still not exactly free of obstructions if the parents object.

You need to check the specific law relating to the OP's question and then, perhaps, you could quote something official that states that the legal age of consent for sexual activities is 18, as you seem to be suggesting.  I won't hold my breath.

Prostitution is completely illegal in Thailand as is pimping and even paying for sex from a sex worker- see the 1996 suppression of prostitution act, I'm not posting it again. That fact that it's rarely acted on does not change the law as it stands

The topic has nothing to do with marriage and your advice to a 40yo guy is 15yo is ok which will send him to jail in 1 or 2 countries.

Prostitution is not "completely illegal" in Thailand but certain specified aspects of it are such as pimping or paying for sex from a sex worker in certain establishments amongst others.  I'm well aware of the Act, more so than you clearly are, so there's no need to re=post it...you could read it carefully, though, and try to understand what it states.
