The Department of Justice (DOJ) is pushing for a 40-year sentence for the man who assaulted former Speaker Nancy Pelosi's husband, Paul Pelosi, in a shocking incident that occurred in 2022.

 

David DePape, the assailant who broke into the Pelosi residence and attacked Paul Pelosi with a hammer, is facing maximum penalties for the charges he was convicted of in 2023. Prosecutors emphasized the need for both specific and general deterrence in their memorandum filed in a U.S. District Court in San Francisco on Friday.

 

In the memorandum, prosecutors highlighted the prevalence of extremism leading to attacks on public and elected officials, framing the case as an opportunity to deter individuals harboring violent ideological intentions. They emphasized that violent ideological attacks would be met with severe consequences under the law.

 

DePape was found guilty of assault and kidnapping charges in November of the previous year. The terrifying incident unfolded when DePape entered the Pelosi residence on October 28, 2022, reportedly searching for the then-Speaker of the House. He proceeded to assault Paul Pelosi with a hammer before law enforcement intervened. Notably, Nancy Pelosi was in Washington, D.C., at the time of the attack.

 

Paul Pelosi suffered serious injuries, including a skull fracture and arm injuries, requiring hospitalization for several days. During his court appearance, DePape offered an apology, asserting that Pelosi's husband was never his intended target.

 

Prosecutors are now pushing to categorize DePape's crime as an act of terrorism, underlining the gravity of his actions and their broader implications. The case has drawn significant attention as a symbol of the dangers posed by extremist ideologies and the importance of swift and decisive legal action to uphold public safety and deter future acts of violence.

A reasonable sentence...  IF that's the same sentence he'd get if he assaulted any other citizen in their home.  

 

Had he assaulted any normal citizen, he'd be walking within a few months in that part of California, if they prosecuted him at all.  Politicians need to feel the effects of the policies they created.  Then maybe they'll create better policies.

No ‘policy’ gave rise to Paul Pelosi being attacked with a hammer in his own home.

 

That attack was a direct outcome of rightwing vitriol heaped on Nancy Pelosi.

 

And I agree it’s a  case of Terrorism - Stochastic Terrorism - incite hatred with  hate filled rhetoric and someone will act on it.

 

might be worth going back to revisit what posters had to say at the time about the motives of this attack, who the attacker was and why he was at the Pelosi home.

DePape, 43, was arrested at the scene and subsequently charged with attempted kidnapping and assault on account of a federal official's performance of official duties. The charges carry a maximum sentence of 20 years and 30 years, respectively, in prison. He has pleaded not guilty.

 

DePape also faces state charges in the incident. He pleaded not guilty to state charges including attempted murder, residential burglary and assault with a deadly weapon. A state trial date has not yet been scheduled.

 Tell that to the thousands of Californians who have been assaulted, robbed, and carjacked only to see their assailants walk free because of Dem soft on crime policies.  Not to mention all the former employees of stores that closed down because they couldn't stay open for all the shoplifters enjoying their free <$1000 stuff. 

 

Then to watch a guy get a 40 year sentence when he assaults a politician...

Who was performing an official duty in their home?  Once again proving my point.  They have laws and enforcement to protect themselves, but not the public.  Had he assaulted any normal Joe Schmoe in a home invasion, he'd be out by now.

True. But Joe Schmoe would not have received federal charges. And the defendant said he was looking for Ms. Pelosi, not her husband.

I think the guy should be hung from the rafters.  But so should anyone going after Joe Schmoe with a hammer in their home. 

 

Perhaps politicians would get tougher on crime if they had to watch their assailants walk free, like the thousands of other victims in the wake of "defund the police".  The problem is that politicians are shielded from the world they create for the rest of us.
