hello,i went to the immigration in soi suan phlu to get a non-o for my 3 years old kid. I came all the way down almost 300 kms from the north just to know that they need 21 days prior to the expiry before they can give me an extension.i asked them to consider since my son is under 7 years old and i know about the policy that he don't have to pay for an overstay.Am i right?But anyway,the officer told me to pay for a visa extension for 7 days in counter 5 and i have to pay for 1900 baht for it before going back to room 303 and pay for another 2000 baht for the non-o visa.

My question is that,why didnt they advice me that it's okey for my son to stay even without a non-b since he is under 7 years old?

You say here you came all the way for a non immigrant O for your child (which I assume will be extended) and they provided an option to you that allowed you to do so. I am sure they were trying to help you do what they understood you wanted to do - am not sure why you would want them to try and talk you out of it.

Everybody requires a visa/permitted to stay if here on a foreign passport. If your child exits with an expired permitted to stay there will be an overstay marked in the passport. It is true there has been no fine involved and often officers would say to just ignore the visa/stay requirements for that reason. But several recent reports seem to indicate that may not be as common as before and that children are being encouraged to obtain/maintain there visa status (but this is my opinion from very limited reporting so may not really be the case at all).

Hi,thanks for the immediate reply.I'm just kinda worried because my non-b is going to expire on the 21 of October and my son's non-o expires on the 11 of October.Isn't it supposed to be the same?If i'm going to renew my contract in the same school,i need 21 days renewing it prior to it's expiry right?So we won't have the same date...I have tried to contact 1111 but they don't have the correct information and tried reaching the numbers given on the immigration website but no answers,all i can hear are just recordings.

Please advice me .

I believe your son obtain a change of visa (2,000 baht) so that would be in anticipation of your having an extension of stay for one year at a time from Immigration and that his 90 day stay would be extended to match your extension. To extend his stay to match yours requires a TM.7 and 1,900 baht more.

You do not need 21 days remaining to renew if on a non immigrant visa entry - they prefer you do with that much time but have not heard of anyone being required to have any amount of time. In this case you want to do it early.

Believe you should renew your stay prior to October 11 - then apply for extension of stay for you son to match your stay. If you are not able to do that it would be an extra 1,900 baht as his first extension would only cover up to your current October 21 date.

It is an on/off thing Lop. Changes by the mood of the officer on the day.
