A federal judge has permanently barred President Donald Trump from deploying the National Guard to Portland, Oregon — a major blow to the administration’s months-long effort to send troops into Democrat-led cities under the banner of “law and order.”

 

US District Judge Karin Immergut, a Trump appointee, ruled that the president had no lawful basis to federalize Oregon’s National Guard, saying there was “neither a rebellion nor danger of one” to justify military intervention. The 106-page decision converts earlier temporary restraining orders into a permanent block on any federal troop deployment to the city.

 

Immergut found that Trump’s actions violated the 10th Amendment, which reserves powers not delegated to the federal government for the states. “Wherever the line lies for when a president can deploy the military in American streets, defendants have failed to clear it,” she wrote.

 

The ruling marks the first time the Trump administration has been permanently stopped from sending troops into a US city. The White House is expected to appeal, and the case could ultimately reach the Supreme Court.

 

Trump had tried to mobilize Oregon’s Guard and even send units from California and Texas to Portland to suppress protests against federal immigration raids. The Justice Department described the city as “war-ravaged” and claimed local leaders refused to act.

 

But Oregon officials and Portland residents disputed that narrative, saying violence was limited and handled by local police. Portland’s attorney Caroline Turco said the ruling reaffirmed constitutional limits: “This case is about whether we are a nation of constitutional law or martial law.”

 

The decision is seen as a broader test of executive power and the president’s ability to override state authority — an issue now likely headed toward another showdown in Washington.

Both the Supreme Court and lower courts are now doing the lawful and right thing. Glad to see it. The noose is tightening.
