BIR Suspends Field Audits Amid Corruption Probe Calls

The Bureau of Internal Revenue (BIR) has halted all field audits and related operations, ceasing the issuance of letters of authority (LOA) and mission orders. This decision came in response to pressure from senators urging an investigation into alleged corruption within the agency. BIR Commissioner Charlito Mendoza announced that the suspension aims to reform current practices, emphasizing no LOA will be issued during this period.

 

Commissioner Mendoza indicated that the suspension is part of broader reforms with guidance from Finance Secretary Frederick Go. It targets systemic weaknesses while ensuring alignment with priorities like good governance and taxpayer protection. This pause covers audits conducted in the past six months, but excludes crucial cases like active criminal investigations.

 

To address these challenges, a technical working group will be formed to evaluate and update LOA procedures. Mendoza aims to create processes that are "predictable, evidence-based, technology-driven and fair" to protect taxpayers while ensuring efficiency. Finance Secretary Go highlighted the need for a full review of BIR policies to curb any abuse.

 

Senator Erwin Tulfo has called for a deeper investigation into the agency, describing the situation as a "money-making scheme." By filing Senate Resolution 180, Tulfo seeks to address allegations of abuse, where LOAs have been reportedly misused to extort businesses. Complaints from companies nationwide suggest LOAs were exploited, even against those who had fulfilled their tax obligations.

 

The alleged scheme involves collusion among examiners and regional officials, who may be summoned for hearings. Tulfo noted a connection between these allegations and the previous BIR leadership under former commissioner Romeo Lumagui Jr., stating that LOA abuses intensified in 2024. He claimed LOAs were used beyond their legitimate purpose to meet collection targets, with some collected funds diverted as kickbacks.

 

Tulfo also highlighted a specific incident involving a company pressured to settle a liability for a reduced amount, with BIR officials pocketing the difference. More senators, including JV Ejercito, Loren Legarda, and Raffy Tulfo, have received similar complaints, reinforcing the urgency for a thorough investigation.

 

Looking forward, the Senate Blue Ribbon committee is poised to take up the investigation into the BIR’s practices. As the probe continues, reforms and updated procedures are expected to be implemented to enhance transparency and fairness in BIR operations, reported PhilStar.
