Sure, while the death penalty is no longer mandatory in Malaysia, it's still on the books but they are also having a moratorium on executions. That said, 30-40 years in prison and a minimum of 10 strokes of the cane doesn't sound any nicer. In Thailand, while he can be sentenced to death, it is rarely implemented for drug offences. However, like a Malaysian prison, spending the remainder of your natural inside a Thai prison doesn't seem like the soft option, either. With or without the caning.
