13 Sentenced Over English Channel Boat Sinking That Killed 31

Featured Replies

Thirteen people have been sentenced to prison terms of up to 10 years in France over the November 2021 sinking of a boat in the English Channel that killed 31 migrants, in one of the deadliest incidents of the crossing.

The sentencing took place on Wednesday, nearly five years after the tragedy. The victims were mostly Iraqi Kurds. Fourteen people had been tried at the trial in Paris, which began on September 8, and one defendant was acquitted.

Prison Terms after Court Case in Paris

Of the 14 defendants, 13 were convicted and received sentences ranging up to 10 years, according to the court. Two of the defendants were not present and remain at large.

Defence and prosecution accounts centred on allegations that the defendants arranged and facilitated the attempt by sea, despite the boat being unsuitable for open-water travel. Prosecutors also said it was overloaded and lacked appropriate life-saving equipment.

Emmanuel Daoud, a lawyer for families of the victims, said that the deaths of 31 people meant “there is a price”, adding that the court had set that price through prison sentences.

Charges Linked to Smuggling Methods

The court said the case illustrated the consequences of the methods used by smugglers, describing how those responsible profited from the vulnerability of people trying to flee their situation.

Authorities said the boat was meant to carry migrants across the Channel as part of a smuggling operation. The prosecution told the court that the vessel was unfit for navigation on the open sea and that it did not meet basic safety requirements, despite people being pushed to attempt the crossing.

Investigation Into Alleged Failure to Assist

Separately, an investigation into seven military personnel indicted for failing to assist survivors remains under way.

The inquiry followed an alert from a fishing vessel that reported bodies in the water off the coast near Calais.

French authorities recovered 27 bodies, including two teenagers and a child. Four other victims were not recovered.

Survivor Accounts and Circumstances of the Sinking

Court documents described how one survivor told investigators that he had taken part in an earlier failed Channel crossing with 53 other migrants. Rescue teams brought them back to the French coast, and he said his family in Iraq had funded his attempt, paying $3,200 for passage.

The documents said the same smugglers’ network organised the second attempt, which began on November 24, when a small grey boat with a 40 CV outboard motor was launched.

The court heard that the boat had been prepared in a wooded area before being put into the water. The migrants, wearing life jackets provided by the smugglers, set off at around 10pm local time.

About four hours later, the boat began to deflate and the motor stopped. With no engine power, the vessel drifted with the currents.

According to the account heard at trial, some passengers wanted to return to France while others tried to reach England. Several people who spoke English attempted to contact emergency services as the situation deteriorated.
