I have finally found a way to change my existing 1-year visa extension (based on study), to a visa extension based on marriage. (This is because I want to get a WP).

My local immigration office will not 'play ball', but I've found an office that will :o

I understand most of the document requirements, but need clarification on tax documents to provide. These are tax documents based on my Thai wife's salary, as owner of her sole-trader business (our hotel).

My wife's accountant has recently submitted the PorNgorDor 90 tax return (for a 6 month period). But I think we have to provide that document, as well a receipt for payment of the actual tax, as well as other tax documents??

Can anyone advise me?

By the way, regardless of which immigration office we speak to, they all insist that my wife has a salary > 40,000 baht per month AND that I have more than 400,000 baht in the bank. Please do not tell me that this is incorrect. I know that! Perhaps someone could tell these immigration officers :D

Anyway, advice is appreciated re the tax documents.

I have had dealings with immigration over the last few months, trying (eventually unsuccessfully) to get an extension under 7.1. My experience was that you have to read the regulations incredibly carefuly to ensure your paperwork in order.

Looking at the Thai Police translation of 606/2549 7.17 - which I guess you are applying under, it states as a condition for visa extension:

(6) In the case of an alien married to a Thai woman, any party or both must have a total income of not less than Baht 40,000 per month, except for aliens who entered the Kingdom before this Order came into force and granted a permit to stay in the Kingdom. If the alien does not have the minimum income above, he shall have an account deposit in Thailand in the name of either party or both of not less than Baht 400,000. Proof of account deposit for the previous 3 months is required.

and

Only for clause (6), there shall be a letter of confirmation from a bank in Thailand and copy of bank book or proof of income of either party or both in the total amount of not less than Baht 40,000 per month, such as personal income tax return with receipt, proof of pension, proof of interest from bank account deposit or proof of other income from authority concerned.

I am sure you have already seen this clause many times. But I think that it would be much better to just show your wife's personal income tax return (Por Ngor Dor 91) for last year. As soon as you start showing company tax returns, immigration are going to want to see a raft of all other kinds of company papers, audited accounts, social security and tax returns as proof. I don't however know if you can also make a Por Ngor Dor 91 return as a company owner.

I’m quite sure when Simon said “sole trader” he meant “sole proprietorship”. When a business is registered as a sole proprietorship, the business’s profit and the proprietor’s personal income are synonymous.

Aside from that, in Phuket posturing with a copy of Police Order 606/2549 does not get you anywhere, according to several reports from members about that particular immigration office.
