You will have been out of the country for 98 days by my calculations.

The visa regs say you can have a maximum of 90 days in any 180 day period on visa exemption. 180 days counting back would be from July 13th, and therefore you have spent 82 days here in the last 180 (counting back from Jan 9th). That entitles you to an 8 day stay going by the book.

Having said all of that whether or not immigration actually figure this out is another matter. All your visits here are recorded on computer, so having a new passport won't make any difference.

The rule is 90 days in a six month period (not 180 days) so six months from July 12 would be January 13st and that should be your safe entry date. But it is best to obtain a real tourist visa and not have to worry about the 'count of the day' process. If you have to fly that is another fly in the ointment as they could also cause you a problem without a visa.
