Hi guys

I need to apply for an extension of my multi "o" visa which runs out in February..... I do not have a work permit and so can not declare my work legally but I do have over 250,000 bht savings and that increases by 50,000 each month that passes. I also have several plots of land in my wifes name if thats of any use. So where is the best place for me to apply for an extension right now other than my home country ??

You do not appear to meet the requirements of an extension of stay so you can not apply anywhere. For an extension of stay you must be able to prove 40k monthly family income. I assume you can not use Embassy letter of overseas income from your above post and your wife can not meet the income requirement.

So the best you can obtain is a multi entry non immigrant O visa valid for one year of 90 day stays. You might be able to obtain in Penang or KL but it is not a sure thing. You would need marriage certificate/copy, copy of wife id card and bank account information. Otherwise you will probably have to visit Oz or UK to obtain such a visa. You should be able to get a single entry without the financial proof so all would not be lost if you can not get the multi entry.

cheers for the advice, it does not instill confidence within me to try Penang or KL but I dont really have much choice. The problem is that I do actually earn alot of money here but obviously without a work permit I cannot declare that........ so how best to go about fulfilling the 40k per month quota by using my money to appear as if its my wifes income ?? Do I have to start a business or can my wife justclaim she is earning 40k per month by being a self employed translator...... is this viable ??

Yes, provided she declares the income to the revenue department and pays income tax on it.

thanks for your reply, the more info I have the better I can dealwith this problem

So what proof, if any, does she need to provide to say she is a self employed translator ? and regarding the rule for income of 40k per month, how many months previous would she have to show to enable me to obtain a multi o, is it 3 months like with the bank account details

cheers Maestro, your replies give me a little hope which is better than none but I still have somequestions which I hope you will answer for me if you can.

you say that 3 months of tax receipts should be okay but it begs the question on how to go about setting this up the easiest way.

does my wife just walk into a local tax revenue office and inform them that she would like to pay tax on her "new" business venture of translation for foreigners and their lady friends (this is bogus of course ) and then tell them how much she is earning and then simply pay tax on that ?? All sounds so so simple,surely there must be a catch somewhere........ can anyone enlighten me to the correct procedures please

I think I have found a way through this now. My wife has spoken to an accountant who says its no problem to back pay tax for the last 6 months on a "self employed business" and receive a tax certificate showing that my wife earns 40k per month.

So now my question changes to the benefits of a real marriage visa. I assume I will still have to leave the country come February and travel to Penang to apply for my marriage visa which now I have high hopes of achieving as I fulfill all the neccesary requirements but once I receive this, do I still have to do border runs every 3 months or do I just report to the local immigration office instead to receive my stamps

if you can receive the relevant paperwork from the tax man/accountant in time, then you shouldn't have to leave the country at all.

You do down to immigration within last 30 days of your current non-immigrant entry and apply for an extension. As with all applications, there will be a 1 month 'consideration' period after which you'll have an extension of stay.

If I'm not mistaken you'll be given 9 months permission to stay in Thailand (ie you've already been here 3 months, extending by 9 will give you 12 months all up). This time next year, you then again trot down to immigration where you'll be given an additional 12 months entry, so long as you meet all the requirements.

So no need for border runs any more. You only need to remember to do the 90 day reporting and get a re-entry permit so your visa doesn't lapse if you decide to do any international travel/holidays.

There is no such thing as a marriage visa.

You will be applying for a one year stay based on marriage to a Thai.

Assuming you have your certificate from the tax office proving 40,000 a month.

Go to your local immigration office with your marriage certificate, passport, entry card, tax certificate. Wifes ID card, Wifes house registration book. Your bank book. All coppied and signed in triplicate. Application form, you can download the form or Immigration will have one. Map of where you live, photos of you and your Wife in and outside your residence. Take your Wife as she will be interviewed. Expect a visit to check that you and your Wife live together, maybe the neighbours will be interviewed.

If all is correct you will get an underconsideration stamp for 1 month. After the 1 month you should go back and get another 11 months. (maybe a little less as said)

It,s not as complicated as it sounds. Some of the above requirements may not be needed, it all depends on the office you apply to. Suggest you go and have a chat with them to see what they require.

After this you only have to report your address to Immigration every 90 days.

Thank you very much that advice, really appreciated as it has taken a great weight off my mind. The local immigration office knows me well so I hope I can avoid the house visit but I will take a trip down there to chat with them before hand

To help out others who have been asking about this. Any chance of you disclosing the amount of tax you are paying on 40,000 Baht a month. We have had a few different opinions on this.

40K per month will mean you pay about 2,300 baht in tax per month, or about 37K in tax per year. This is before deductions, which lower the sum. Having a spouse, child, investments in Long Term Funds, pensions and insurance can all bring down your tax liablity considerably.

I will happily disclose the amount of tax I will have to pay once the accountant hasworked out what deductibles we are entitled to. This will take a few days but I will be certain to update this thread then
