more drama my buddy's laying on my internet-savvy plate... our question is, since he's on almost a 3 month overstay should he spend the money he doesnt really have to spend right now on leaving the country to pay overstay and subsequently get non-IMM visa now, or can he wait a couple months when he will have the money (bank problems, not income problems; long story)?

obviously he'd prefer to wait 2 months when his situation has improved and can afford to go travelling...

does 3 months overstay or 5 months overstay really make a difference?

It makes no difference whatsoever, unless he gets checked by police and arrested. In that case, he will be sentenced by a judge to pay a fine, maximum 20,000 Baht and to be deported. If he wants to wait two months until he leaves he can say that he has no money and remain at the Immigration Detention Center until he feels ready to buy a ticket and leave.

How will his financial situation improve in 2 months ?

A British associate of a friend of mine got into the same mindset after 3 months of overstay. He eventually and finally decided to leave after 6 years on overstay as it was during a time when he had the funds for passport replacement (the previous one having been expired for several years), air tickets, and fine payment.

He returned a month later on a yet another new passport and a 60 day tourist visa, but then dropped out of sight about a year ago. Something tells me he's not left.

if he can stay out of sight, wait the two months and then get an air ticket out before showing up at the airport with the 20k.

obviously will be more problems if during the two months he gets questioned/arrested but apart from that, under the current rules,

i think better to overstay for long periods in order to get your moneys worth. just don't get caught before you get to the airport.

maybe during the next two months they raise the bar to 50k, this is thailand, then what will your friend do?

i had a 6 month overstay, showed up at the airport with the 20k and came back two days later with a non imm b and only let the

overstay continue in order to get the most bang for my baht.

i'd expect the max penalty will be 50k or 100k or more soon enough.

Although I didn't condone it, that's exactly what the Brit said. He proclaimed that with his method, his "visa" staying costs in Thailand only amounted to 3,333 baht per year all in... which I certainly couldn't compete with, expense-wise, but peace of mind to me is worth every satang over that amount.

great thx... not the answers i was thinking we'd get... figured that the hellascious overstay would deter the consulate from issuing his non-IMM O

With them clamping down on visas and changing the rules all the time, I would not rule out that it could cause a problem at some consulates at some point in time.

Why do you expect that?

The daily fine increased from 200 to 500 back in about March 2006 but the maximum stayed at 20k. That would have been the time for an increase, but it didn't.

Perhaps they felt the imprisonment provision should negate the need for a higher fine - obviously most people are only thinking a fine is involved - be aware of the full possible consequences:

Section 62 : Whoever fails to comply with the provisions of Section 11 or Para.2 of Section 18 shall be

punished by imprisonment not exceeding two years and a fine not exceeding 20,000 Baht.
