NCCC: Deputy Commerce Minister Could Face Impeachment

After an impeachment was launched against the Public Health Minister for failing to declare all his assets, the Deputy Commerce Minister could be the next one in line for impeachment.

According to the Spokesperson for the National Counter Corruption Commission, or NCCC, Klanarong Chantik, Deputy Commerce Minister Viroon Tejapaibul is now being investigated by the anti-corruption agency.

It was earlier reported by the media that Viroon currently owns more than five percent in a private company and failed to disclose his shares to the NCCC within 30 days as required by law.

Klanarong says the committee is currently investigating the allegations. Preliminary investigation, he says, suggests that Viroon, indeed, owns the shares.

The NCCC should come to a decision within today as to whether or not impeachment charges will be brought against the Deputy Commerce Minister.

Public Health Minister Chaiya Sasomsab was the first minister of the Samak administration to face impeachment proceedings for failing to report all of his and his wife’s assets.

Wiroon shares probe

The National Counter Corruption Commission (NCCC) will rule on Tuesday on whether Deputy Commerce Minister Wiroon Techapaiboon's holding of an 11-per cent stake in a private company is a violation of the law, commission and spokesman Klanarong Chantik said yesterday.

Wiroon will file clarification of his holding of 22,000 shares, worth 2.2 Million Baht, in the Sappawatana Company to the NCCC in a few days, he said.

However, Wiroon has already consulted the NCCC on whether he must declare his holdings in a company that had already closed.

The commissioners have assigned investigators for both cases to report by Tuesday, besides a further report on Cabinet members holding shares of more than 5 per cent in companies.

Senators endorse Chaiya judicial review

A group of 36 senators yesterday endorsed the launch of a judicial review into the qualifications of Public Health Minister Chaiya Sasomsap.

The review concerns his alleged violation of the 5-per-cent limit on equity stakes. Chaiya has been disqualified by the National Counter Corruption Commission but refuses to resign until the Constitution Court rules on his status.

To dispel doubts, the senators signed the petition to ask the Constitution Court to rule on the matter.

Group of 36 Senators press for Chaiya ministerial judgement

BANGKOK, April 18 (TNA) – A group of 36 senators filed a petition Friday seeking the Constitution Court's judgment on the ministerial status of embattled Chaiya Sasomsap, whose spouse reportedly holds, or previously held, more corporate stocks than legally allowed.

The 36 senators, including Bangkok senator Rosana Tositrakul, petitioned through the Senate Speaker for the Constitution Court to judge whether or not Chaiya's status as Minister of Public Health should be terminated under the constitution's Article 182 following the National Counter Corruption Commission's finding that his spouse, Jurai, has held more shares of a private firm than the maximum 5 per cent authorised by law.

Through the Senate Speaker, legislators in the upper house may forward charges against any cabinet member or other persons with political status for final rulings by court besides the Prime Minister, the Parliament President and the Election Commission chairman.

Meanwhile, Constitution Court secretary general Phaibul Warahaphaithoon said the senators' petition against the public health minister would be handled under normal procedures by the Constitution Court no matter how soon the current judges attached to the court are scheduled to retire and be replaced.

The Constitution Court will likely work on the petition for a 15-day period if it is accepted, according to the court's secretary general.

Promises to help illegal radio operators

PM's Office Minister Jakrapob Penkair has put himself in the line of fire by telling illegal community radio operators they will not be arrested if they agree to work with the government. He promised the operators that he would find ways to help community radio stations continue their operations despite being outlawed by the Radio and Television Act that took effect on Mar 5. More than 4,000 community radio stations are in operation nationwide. Senator Somchai Sawaengkarn, who helped push for the law, insists that it should not be amended as it was designed to benefit radio operators who truly work for their communities. The new law demands legal action against operators who are caught broadcasting commercials which they are not supposed to. Jakrapob would be seen as instituting a double standard if he chose to help the illegal radio operators. ''It would also mean allowing people to break the law,'' the senator said. The law must be universally enforced, with no exception. Somchai warned the minister against favouring the radio stations that are ready to become ''mouthpieces'' of the government. The minister could risk being removed from office as his action could be deemed as a conflict of interest, he warned.

Jakrapob faces threat

The opposition Democrat Party yesterday threatened legal action and an impeachment campaign against PM's Office Minister Jakrapob Penkair for alleged abuse of the mass media

Boonyod Sukthinthai, a party MP for Bangkok who is also a member of its Media Rights and Freedom Protection Committee, said the Democrats had sought Jakrapob's explanations about his recent moves that were viewed as political interference in the media's operations.

If the minister, who oversees state-run media establishments, failed to cooperate, the party would take legal action against him for abuse of power, Boonyod said. He said there would also be a signature campaign for the minister's impeachment.

The opposition MP pointed out that Jakrapob recently ordered the state-run Channel 11 to be turned into NBT.

Boonyod yesterday also accused the minister of using state media for ruling politicians' interests. He said Jakrapob had ordered the Public Relations Department to allow pro-government community radio stations to broadcast in support of the Constitution amendment effort. He also claimed that community radio stations in Khon Kaen were forced to air pro-government propaganda pieces at least two hours every day.

Jakrapob in hot seat over NBT

The Democrat Party has threatened to sue PM's Office Minister Jakrapob Penkair for allegedly abusing his power and interfering in the affairs of the National Broadcasting Service of Thailand (NBT). Democrat MP for Bangkok Boonyod Sukthinthai, a member of the party's committee to protect the rights and liberties of the media, said his party would sue Jakrapob for allegedly misusing his ministerial power. Boonyod added that this may lead to moves to gather signatures to remove him from office. He came under fire for his decision to turn state-run Channel 11 into NBT and for alleged interference in the new station. Democrat Deputy Leader Alongkorn Ponlabutr had earlier asked the Office of the Auditor-General to see if there was any collusion between Jakrapob and the firm which won the contract to produce news programmes for NBT. Digital Media Holding Co won the contract to produce at least nine and a half hours of news per day. The OAG is looking into allegations that he may have helped Digital Media win the contract. Jakrapob also found himself in the hot seat after he told illegal community radio operators in Khon Kaen on Saturday that they would not be arrested if they agreed to work with the government.

When the NBT, which was run by the Public Relations Department, called for bidding for the contract to produce news programmes, only two companies took part in the bidding. They were Digital Media and KL Media Product Co, he said. Jakrapob selected Digital Media and signed a partnership contract with the company on March 7. After signing the contract, Digital Media raised the annual return amount it promised to pay NBT to 40.5 million baht, which is still much lower than the amount of revenue it is expected to reap through its news programmes annually, said Mr Alongkorn. Calculating NBT's rates for commercial airtime of nine hours a day, Digital Media was likely to earn more than 1.5 Billion Baht in advertising revenue annually. From the amount, Digital Media should be able to pay more than 750 Million Baht in returns to NBT, said Mr Alongkorn. After checking the profiles of Digital Media and KL Media Product, the two companies were found to share the same address and telephone number. They were both located at 731 Asok-Din Daeng road. Digital Media Holding was set up only five months ago. Mr Alongkorn said he wondered why NBT and Mr Jakrapob did not select a partner with experience in the media industry.

Chaiya case due in court by Monday evening

Senate Speaker Prasobsuk Boondej believes the upper house will be able to verify documents questioning Public Health Minister Chaiya Sasomsub’s capabilities and forward them to the Constitution Court for further deliberation by Monday evening. "We are now in the final stages of examining related documents," he said. Senate Speaker sends ministerial status case for Constitution Court ruling

BANGKOK, April 21 (TNA) -- Thailand's Senate Speaker Prasopsuk Boondej on Monday forwarded to the Constitution Court a removal petition by senators for it to rule on the ministerial status of embattled Public Health Minister Chaiya Sasomsup, whose spouse reportedly holds more corporate stocks in a particular company than legally allowed, according to the Secretariat of the Senate.

The Secretariat said Mr. Prasopsuk had signed his name approving the petition before forwarding it to the Constitution Court to rule on Chaiya's fate.

Earlier Monday, the minister said he would continue working until the Court ruled that he must leave the post.

It was reported last Friday that a group of 36 senators had filed a petition seeking the Constitution Court's judgment on the ministerial status of Chaiya after the National Counter Corruption Commission found that his wife, Jurai, has held more shares of a private firm than the maximum 5 per cent allowed by law.

The Constitution Court will likely work on the petition for a 15-day period if it is accepted.

EC to Review Qualification of Public Health Minister on Wednesday

The election watchdog is set to review on Wednesday the qualification of the embattled Public Health Minister, who has been indicted by the anti-graft agency in an asset concealment case.

Election Commissioner Prapun Naigowit said that the EC would meet tomorrow to discuss the qualification of Chaiya Sasomsap as the Public Health Minister and the status of the investigation into his wrongdoing.

Chaiya has been in the hot seat since the beginning of this month, when the nine-member National Counter Corruption Commission (NCCC) voted unanimously that Public Health Minister Chaiya should be disqualified from holding office for violating a five-per-cent limit on equity ownership.

NCCC member and spokesman Klanarong Chantik said then that according to the agency’s ruling, Chaiya is disqualified from his post as per Article 182 of the Constitution and now it is up to the Prime Minister, Election Commissioner, the House of Representatives or the Senate to enforce his removal.

Commissioner Prapun said that he has been informed that the Senate has already submitted Chaiya’s case to the Constitution Court for further consideration.

Journalist Association Moves against PM's Office Minister

The Broadcast Journalist Association condemns the PM's Office minister, who is in charge of mass media supervision, for abuse of power after he asked a community radio station to present positive coverage on the government's work in return for legal protection.

The Thai Broadcast Journalist Association released a statement today opposing the attempt by Prime Minister's Office Minister Jakrapob Penkair to guide the content of community radios across the country.

The statement expressed the association's disapproval of Jakrapob's proposal to grant legal protection to community radio stations in the return for positive coverage of the government's work.

The association deems that the PM's Officer Minister is attempting to use his authority to indirectly force the operators of community radio stations to stand with the government, and that his remark that the stations that follow his policy will not face legal action for operating a radio station without a license is illegal, as the move could be an attempt to direct state officials to abandon their duties.

Developments on Embattled Ministers

Many ministers within the Samak administration have drawn a lot of public criticism.

Two are in direct line of fire today as the country’s anti-graft agency decides whether the Deputy Commerce Minister is in violation of the law by not declaring all his assets.

The Interior Minister, meanwhile, is answering questions in Parliament about the reinstatement of his son into the military.

Member of the National Counter Corruption Commission Klanarong Chantik says that today, the NCCC should come to a decision on whether or not Deputy Commerce Minister Viroon Tejapaibul has violated the law by not declaring all his assets.

Viroon was earlier found to have more than five percent ownership in a private company, Supwattana Company Limited. Although he claims that the company suffered losses and was closed down years ago, the NCCC reports indicate that the company was never officially shut down.

If found guilty, Viroon could face impeachment charges as Thai ministers are required to declare all their assets when entering and leaving office.

Meanwhile, Parliamentary sessions kicked off at approximately 11 a.m. On the agenda is another embattled minister, Interior Minister Chalerm Yubamrung.

He’s being asked by the Opposition to explain the sudden reinstatement of his son back into military ranks. The minister’s son, Duang Yubamrung, was once accused of first degree murder. He fled the country, causing the Defense Minister to strip him of his rank. However, he later returned to Thailand to face charges and was later found not guilty.

Yesterday, Prime Minister Samak Sundaravej, acting as Defense Minister, signed Duang’s reinstatement to the force.

The reinstatement has met with widespread criticism. Questions are being raised as to whether Duang’s come back is merely because his father is a member of the Cabinet.

Graft Fighting Panel Rules to Disqualify Deputy Commerce Minister

The National Counter Corruption Commission (NCCC) has agreed to take legal action against the Deputy Commerce Minister for holding shares in a company above the legal limit of five per cent.

In today's meeting of the National Counter Corruption Commission, members agreed to launch an indictment against Deputy Commerce Minister Wirun Techapaiboon, which could in turn result in the nullification his minister status.

The panel cites that Wirun has violated the Act that prohibits Cabinet members and their spouses from holding more than five per cent of shares in a company.

The NCCC's examination result has shown that Wirun has acquired 11 per cent of the overall shares of Sapvadhana Company, but failed to file this part of his assets to the panel when he was endorsed as a minister.

Wirun informed the NCCC on April 18th that the company has already quit its business, but the period for ministers to declare their assets was complete, so he says the panel has no authority to re-examine his wealth. However, the NCCC's investigation showed that the company did not file for closure.

The NCCC will forward its resolution to the prime minister, House Speaker, Senate Speaker, and Chairman of the Election Commission for a decision on whether to submit a complaint with the Constitution Court to seek a ruling on Wirun's ministerial status.

A similar incident happened with Public Health Minister Chaiya Sasomsap as he failed to notify the NCCC of his wife's 50 per cent stake in a private company within the given timeframe. The Senate Speaker has already sent a petition for his impeachment to the Constitution Court.

Khunying Kalaya Sophonpanich held a press conference claiming that Commerce Minister Mingkwan Sangsuwan secretly signed the Asean-Japan Comprehensive Economic Partnership pact (AJCEP) on April 11, which she said was a possible legal violation. According to law, the Commerce Minister was required to put the issue before a public hearing before going ahead with the signing of the pact. His actions have now raised concerns about a hidden agenda. "The signed deal was not done through a public hearing according to article 190 of the Constitution and there are now growing concerns that the country will feel the negative repercussions of this deal," said Khunying Kalaya. "We would like to urge the government to make public, details of this pact because the people have a right to know."

I read about it yesterday, it's really getting ridiculous - government ministers signing treaties clearly violating the Constitution.

From a business point of view enticing the Japanese to increase their investments in Thailand makes complete sense. From a legal standpoint government officials unilaterally signing bilateral agreements is a bombshell. The Khunying has never been the type to accuse without justification. Mingkwan has a lot of explaining to do.

BANGKOK, April 13 TNA) - Thailand, a member of the Association of Southeast Asian Nations (ASEAN), will accrue more benefits after it signs the ASEAN-Japan Comprehensive Economic Partnership (AJCEP) agreement with Tokyo, Thailand's Deputy Prime Minister and Commerce Minister Mingkwan Saengsuwan said Sunday.

The AJCEP accord will cover commercial trade, service, investment and economic cooperation between both sides while Thailand has proposed to Japan that it would also adhere to the Japan-Thailand Economic Partnership Agreement (JTEPA) which has been in force since November 1, said Mr. Mingkwan.

Details of the Japan-ASEAN pact will be officially announced by the 10-member countries of ASEAN and Japan after all have signed the agreement.

For Thailand's part, the agreement which it had just signed for the AJCEP must first be approved by Parliament, he said.

Under the AJCEP accord, Japan will reduce up to 90 per cent of the total tariffs for goods imported from ASEAN and either reduce or waive another 6.7 per cent of goods tariffs within 10 years.

Thailand will gain more from AJCEP than from JTEPA as the Tokyo government will reduce taxes imposed on 71 goods items faster and also at the same time allows Thailand to use raw materials manufactured within the region, said Mr. Mingkwan.

Thai exporters will receive more benefits for goods exported to Japan under the AJCEP agreement, he said.

Currently, goods imported by Japan from ASEAN are valued at about US$162 billion annually, and Japan is the number one trading partner for the bloc. Its investment in ASEAN also ranks first, totaling about US$11 billion yearly.

Gotcha, multlateral not bilateral.

Still a possible legal issue as it has been signed without a public referendum as called for by Article 190 of the Constitution. Normally, approvals occur PRIOR to agreements being signed, unless signed in principal only. While we don't know on what basis the agreement was signed, given it is Khunying Kalaya who has made the accusation (she has a reputation in Bangkok for being a straight shooter), I would say there is more fire here than smoke.

Chalerm reveals a plot to destabilise the government

Interior Minister Chalerm Yoobamrung on Friday claimed there was a movement aimed at discrediting and undermining the government by trying to stir up disturbances as a frameup to pin the blame on authorities.

"I confirm there is no one in this government who hates or wants to bicker with General Prem Tinsulanonda," he said in reference to this morning's incident which anticoup activists shouted foul words in front of the residence of the president of the Privy Council.

Public Health Minister complains and blames his officials

The Public Health Minister, Chaiya Sasomsap, complained about his job at the Health Ministry and blamed health officials for having a low emotional quotient even if they have a high level of intelligence.

"I was proud to work at the ministry at first, but after working with officials and medical staff for three months, I found it was very hard to work with them. I think they have a high intelligence quotient but low emotional quotient," he told 200 participants who attended the annual seminar of the Pharmaceutical Association of Thailand at the Century Hotel.

Chaiya said most officials who work in the field of public health do not work together, which created obstacles for him.

He said his father had told him to quit politics several times because he looked tired.

"I told my father to take it easy. I just need more time to prove something in my career," he said

Earlier, Chaiya had told 1,000 supporters in his home town in Nakorn Prathom province that he would have a big surprise for officials working at the ministry. He said he would reveal information that will shock them. :o*he's coming out of the transgender closet???*
