Parents Myanmar And Thai, Child Qualify For Thai Residence?

Featured Replies

I've encountered a situation involving a person whose father is a Myanmar citizen and mother a Thai. They must have met at the border of Mae Sot, and after giving birth to the child, the parents separated. For some reason, the Myanmar father raised the child in Yangon.

I am wondering in a case like this, where at least one of the parents is a Thai citizen, is there anyway that the child can obtain Thai citizenship, or least permanent residency ?

Would the problem be that the baby was not registered in Thailand at birth ? If it was, then obtaining a copy of the birth certificate would be easy from the local amphur.

If the mother is still around, then I am not sure how easy it would be for her to do any of this long after the event. I know girls who are a year or two older than their ID because they were not registered but I don't know if it was a very long time.

Unfortunately the mother had passed away before this issue came to me.

Your very first step is to find documentation proving that your mother was Thai. ID birth certificate etc. Was your birth registered in Thailand ?

the lack of documentation isn't going to help. Though, DNA testing can, if you have contact with the mothers family in Thailand.

Check out posts by a member called 'greenwanderer' who was born in the US but found himself in a situation which is analogous to yours ie insuffient paperwork from his mothers side, who I belive, had also passed away. He ended up getting DNA tests to prove his linkage to family members who were documented Thai citizens.

It took him more than a year, but he got certification of his Thai nationality in the end.

I will have to find out.

If I am able to prove that the mother as Thai, what does the child stand legally ?

then you'll be on the path to getting the childs citizenship, though it will most likely be via DNA tests if the mother isn't on the childs Thai birthcerificate- if he even has one.

As I said, do a search for posts by member 'greenwanderer'

lite beer, thanks for that.

i'm going senile as well, so belated apologies to thairookie as well, as I was certain that greenwander108 (forgot the 108 bit) had done a spiel on the process he went through. I was wrong, he only had referred to it in the context of other questions.

Having said that, this post talks abuot some of the documentation that you need in this post here:

http://www.thaivisa.com/forum/index.php?s=...t&p=1280033

as well as the 'investigating nationality' government department you need to talk to which is called 'พิสูจน์สัญชาติ.

The most likely place to start is down at Suan Phlu, and then go from there.

Alternatively, he also refers to some of the documentation here in his blog - stuff that he had to get legalised before he could make the application
