Attorney-General Forwards People Power Party Dissolution Case to Court

The Attorney-General's Office has forwarded the People Power Party dissolution case to the Constitution Court.

Attorney-General Chaikasem Nitisiri has signed the document concluding the Office of the Attorney-General's investigation into the People Power Party dissolution case.

The case has now been forwarded to the Constitution Court, which is also looking at dissolution cases for the Chart Thai and Matchima Thipataya parties.

This case was sent to the OAG by the Election Commission, who's five commissioners voted unanimously that there is merit to dissolve the PPP and ban all of its Board of Directors from politics for five years, after its Deputy Leader Yongyuth Tiyapairat was found guilty of electoral fraud. He was stripped of his MP status and banned from politics for five years.

The EC said there is reason to believe the Party's Leader and/or its Board of Directors knew about the electoral fraud activity, but did not try to stop it or amend it.

The Constitution Court will now decide whether to accept the case.

The OAG has come under fire on allegations of deliberately delaying this case to benefit the PPP as the EC decided on this case and forwarded it to the OAG on September 2nd.

PPP executives Chusak Sirinin and Sukhumpong Ngonkam have announced that they will fight the case in court and will seek an opportunity to clarify the facts before the court.

EC issues 1 red card and 3 yellow cards to PPP and Pua Paendin members

The Election Commission has issued one red card and three yellow cards to MPs of the People Power Party (PPP) and Pua Paendin Party along with calling for a re-election of Senators in Nakorn Phanom.

Election Commissioner Praphan Naikowit revealed today that the EC has called for a re-election in Constituency 3 of Chiang Mai province to replace PPP MPs Prasit Wuthinanchai and Suraphan Amornwiwat.

A red card has been issued to Prasit along with criminal charges for electoral fraud.

Another re-election is also set to take place in Constituency 2 of Pattani province to replace Pua Paendin MPs Nimuktar Waba and Yusri Susalo after the two were yellow carded.

Nakhorn Phanom Senator Wittaya Innara has also been disqualified for electoral fraud. His case will be forwarded to the Supreme Court and the province will have to hold a re-election.

EC seeks red card against PPP MP, yellow cards against 2 PPP MPs, 2 Puea Pandin MPs

The Election Commission has resolved to ask the Supreme Court to give a red card to a People Power Party MP, and four yellow cards to two PPP MPs and two Puea Pandin Party MPs.

EC commissioner Praphan Naikowit said the EC decided to ask the court to disqualify Prasit Wutthinanchai, a PPP MP for Chiang Mai for alleged vote buying and lift his election right as well as taking criminal action against him.

The four MPs the EC decided to have the court disqualify their victories are Julaphan Amornwiwat, another PPP MP from Chiang Mai's Constituency 3, two Puea Pandin MPs from Pattani - Wimuktar Waba and Yusari Suzalor - and a PPP for Nakhon Phanom Witthaya Inala.

Unlike Prasit, these four MPs would be allowed to contest sub-sequent by-elections if the court agrees with the EC's proposal to annul their victories.

They are suspected of having illegally persuaded voters to vote for them.

The Election Commission has issued a red card to a PPP MP and yellow cards to another PPP MP and two from Puea Pandin, all accused of cheating in the Dec 23 general election. EC commissioner Prapun Naigowit said the EC voted unanimously to ask the Supreme Court's Election Division to disqualify Prasit Wutthinanchai, PPP MP for Chiang Mai, and take legal action against him. The court will also be asked to order Prasit to cover the cost of a by-election in his constituency. The EC also resolved to issue yellow cards to PPP MP for Chiang Mai Jullapan Amornvivat and two Puea Pandin MPs for Pattani, Vimukta Waba and Yusi Sula-lor, for vote buying. The court will be asked to order by-elections in the three constituencies. Unlike red cards, yellow-carded MPs are allowed to contest the re-runs. Mr Prapun said the EC will also ask the court to order a Senate by-election in Nakhon Phanom as the commission had decided to issue a yellow card to Witthaya Inala. The EC is still considering the remaining poll fraud investigation reports against MPs and Senators, but there are only a few cases left.

Constitution Court agrees to begin trials against PPP, Chart Thai, and Matchima Thipataya

The Constitution Court Tuesday agreed to being judicial review in the party-dissolution cases against the People Power, Chart Thai, and Matchima Thipataya parties.

Paibool Warahapaithoon, Secretary-General of the Constitution Court Office, said the three parties would be notified to send their written defence to court within 15 days upon receiving a notification letter from the court.

Court prepares for party dissolution cases

The Constitution Court yesterday decided to launch three separate judicial reviews on the electoral fraud cases - punishable by party dissolution - involving People Power, Chart Thai, and Matchima Thipataya parties.

Following petitions from the Office of the Attorney-General, the court accepted it would decide and rule on whether the three parties should be disbanded, Court Secretary-General Paiboon Warahapaitoon said.

The next step is for defence teams for the parties to file defence writs within 15 days, Paiboon said.

After receiving these writs, the court will then announce scheduling for the three inquiries. The judges will choose either to hold the inquiries concurrently or to arrange them in a sequence based on the complexity of evidence.

In regard to the poor health of People Power Party caretaker Leader Samak Sundaravej, Paiboon said it would not delay the judicial proceedings because Samak could designate a representative to testify on his behalf.

He said it was too early to speculate on how long the inquiries would last.

Dissolution trials to proceed

Dissolving the House will not spare political parties from dissolution trials, according to the Constitution Court. Court Secretary-General Paiboon Varahapaitoon and Pisit Sakdanarong, Secretary to the Constitution Court President, confirmed the court stance after the court, led by Chat Chalaworn, accepted the Attorney-General's request for dissolution trials of the three parties. They are the People Power Party and its two coalition partners, Matchima Thipataya and Chart Thai, in connection with fraud conducted by their executives in the Dec 23 elections. Next, Party Leaders will be given 15 days to present statements countering the charge. Mr Paiboon said the court would pick the Party with the most evidence against it to go on trial first. He expected the proceedings to begin by the end of this month, but could not give the exact time-frame for the trials. Matchima Thipataya Deputy Leader Banyin Tangpakor, the Deputy Commerce Minister, said the party would fight the case in court and was in a better position than the other two of escaping dissolution. PPP Seeks Change of Judges for Party Dissolution Case

The People Power Party plans to submit a motion to impeach the Constitution Court judges in charge of the party dissolution cases, while the Upper House has lodged a petition to the Court to investigate the prime minister for holding shares in a private firm that operates a state concession.

Prime Minister's Office Minister and acting Deputy Secretary-general of the People Power Party, Sukhumpong Ngonkam, revealed that the PPP might submit a petition to check the qualifications of the Constitution Tribunal judges, or for a change of the judging panel because the party is concerned that certain judicial officers involved with PPP dissolution case may be bias against the party.

Sukhumpong said he doubts the investigation procedures related to the party dissolution cases against the Chart Thai and the Matchima Thipataya parties, scheduled to be performed at the same time as the case against the PPP Party, are justified.

However, the PPP has set up a team to deal with the party dissolution case against it, and the party will hold further discussions about extending the time for clarification to the court, from 15 days to one month.

Meanwhile, Deputy Senate Speaker, Nikhom Wairatphanit stated that he has already passed a petition to the Constitution Court to prove that Prime Minister Somchai Wongsawat was holding 100,000 shares in CS Loxinfo Public Company. He said this might be considered investment in a company that operates a state concession, which violates articles 265 and 266 of the Constitution.

Sukhumpong Ngonkam, a member of the PPP team fighting the dissolution case, said the Party has the right to object to certain judges, or even the entire panel of judges, if it suspects they have "vested interests" at stake. PPP Deputy Spokesman Boonjong Wongtrairat said one judge who should not hear the case is Jarun Pukditanakul, a former Justice Permanent Secretary. Some PPP members believe he holds a grudge against fugitive former PM Thaksin, who founded the dissolved TRT Party and has a direct influence on the PPP. The move comes after the Constitution Court on Tuesday agreed to hear the prosecution's dissolution case against the Party, which is based on the conviction in July of a member of the party's executive, former PPP Deputy Leader Yongyuth Tiyapairat, for electoral fraud.

I suspect it will be hard to find judges without a grudge against Thaksin.

But Thaksin isn't in PPP is he?

Oh , but yes they just admitted in court papers that he controls TRT and also PPP.

PPP has vested interests to insert on the court, if they, can too.

A classic Thaksin style manuever.

The government spokesman just said Thaksin isn't to blame for any of this,

since he DOESN'T control PPP or anyone in the government....

so how can he ALSO an impediment to the PPP getting a fair trial?

Although the Shinawatra family tree doesn't always branch the way most genetic disorder researchers would recommend, their numbers are almost limit-less.

Thai prime minister faces vital challenge

Thailand's Constitutional Court has decided to hear electoral fraud charges against three political parties including the ruling People's Power Party (PPP), a move that could result in the dissolution of the three parties.

This is the most vital challenge Prime Minister Somchai Wongsawat has faced since taking office last month, analysts say.

The Attorney-General's Office last Friday petitioned the Constitutional Court to disband the PPP and two of its coalition partners, Chart Thai (Thai Nation) and Matchima Thipataya (Neutral Democratic), on electoral fraud charges.

Under Thailand's constitution, if any individual executive of a political party is convicted of committing fraud or vote buying, the party must be dissolved and all its executives banned from politics for five years.

Months-long anti-government protests led by the People's Alliance for Democracy (PAD) have plunged the country into political turmoil, but those do not have the muscle to topple the government, analysts say.

However, if the PPP is found guilty of electoral rigging and therefore dissolved, the current government would collapse since all PPP executive members will be banned from engaging in political activities for five years.

Somchai has got bogged down in a deepening political crisis that has lasted for months and even paralyzed the government, analysts say. Anti-government protesters have staged rallies against two successive governments led by the PPP since late May. The protesters have demanded the PPP leaders step down and branded them as a puppet of former prime minister Thaksin Shinawatra, who was ousted in a September 2006 coup.

Somchai took office in September to succeed Samak Sundaravej, who stepped down for breaching the constitution by taking payments for television cooking shows.

Simmering tensions flared up on Oct. 7, when police and anti-government protesters clashed outside the parliament building. Two people died and nearly 400 others were injured in the clashes.

The army chief, Anupong Paochinda, has said the government was responsible for the deadly clashes and Somchai should resign.

In addition, Thailand's National Counter Corruption Commission (NCCC) ruled Thursday that Somchai is guilty of dereliction of duty when he was Permanent-Ssecretary of the Justice Ministry. He was accused of "neglecting his duty in not taking action against corruption, which is a disciplinary offense for civil servants."

The NCCC will submit the case to the Justice Ministry to consider punishment against him and the charge could force him from office.

Facing increasing pressure, Somchai has said he would not step down because his resignation would not solve the political crisis.

It will take the Constitutional Court months to reach a verdict on the cases, leaving enough time for Somchai and his party to hammer out a solution to the crisis, analysts say. It is possible that Somchai would dismiss the lower house of parliament and call a snap election before a verdict is announced.

To prepare for the worst, the PPP, regarded as the reincarnation of the previously dissolved ruling party Thai Rak Thai (TRT), has already established a new party named Puea Thai Party. If the PPP is forced to dissolve, the Puea Thai Party will serve as a shelter for PPP members to join and run in the next election.

This will be a duplicate of what happened to the TRT, which was dissolved in May 2007 after being found guilty of electoral fraud. Most members of the TRT were admitted by the PPP who later swept the election in 2007.

If that is the case, it would be unacceptable to the anti-Thaksin camps and the country could face a fresh round of political wrangling, analysts say.

PPP team prepares dissolution defence

The People Power Party's (PPP) executive board yesterday assigned Deputy Secretary-Generals Choosak Sirinin and Sukhumpong Ngonkam and legal expert Yuenyad Jaisamut to defend the Party in its dissolution trial in the Constitution Court. According to PPP spokesman Kuthep Saikrachang, the executive board met yesterday and appointed the team. The meeting, which was headed by PM and acting PPP Leader Somchai Wongsawat, told the team to plan the Party's defence that will emphasise attempts to convince the court that the executive board had nothing to do with the electoral fraud committed by its former Deputy Leader Yongyuth Tiyapairat. Choosak is also Secretary-General to the PM and Sukhumpong is a PM's Office Minister. Besides, the PPP will today ask the court to extend the deadline for it to file a written explanation on the dissolution case with the court by 30 days. Two weeks ago the Constitution Court agreed to hear the prosecution's dissolution case against the PPP, which is based on the conviction in July of Yongyuth, the former Deputy Party Leader, for electoral fraud. Hi all.

Of course these PPP people objecting to Judge Jaron had absolutely nothing to do with a

bomb being thrown into his house. It just surprises me that the police do not even go through the motions of investigating these cases,So obviously linked.

Ten inactive parties disbanded

The Election Commission on Thursday ruled to dissolve 10 political parties on the grounds of having no activities since registering their banners.

EC member Sodsri Satayatham said the EC ruling will be forwarded for the mandatory judicial review by the Constitution Court.

The disbanded parties include Su Puea Thai Party registered by massage parlour tycoon-turned-politician Chuwit Kamolvisit.

Parties hope for reprieve in dissolution cases

Half a dozen tiny and little-known political parties are keeping their fingers crossed, as the Election Commission will next week begin considering whether they should be dissolved for failing to come up with at least 5,000 members within one year of registering as required by the Political Party Act.

Ten other parties were recommended for dissolution by the EC yesterday.

"It's too cruel [to wipe out the parties]," Chokchai Suttawet, leader of the Sangkomdhibadaya Party and president of the Confederation of Thai Political Parties, said yesterday. "The state cannot deny citizens' democratic intent," he said.

His organisation has 15 small, little-heard parties as members. Chokchai, whose party espouses social democracy and wants to recruit only involved, active members, managed to gather only 700 of them since registering last November 9.

The party won only 1,213 votes for its proportional representatives last December, leaving it with no MPs.

Last month, Chokchai, on behalf of the confederation, asked the Constitution Court to review the election law for contradicting Article 65 of the Constitution, which states that citizens have the right to form political parties.

He criticised the idea of disbanding political parties if they failed to achieve 5,000 members and open four party offices in four regions of the country, saying that the requirements were undemocratic and not conducive to the development of electoral democracy. He argued that many big parties have inactive members unlike these small, ideology-driven parties.

The German-educated Chokchai said he would like to see a compromise where, if parties failed to attain the minimum requirements for membership and branches, they would become ineligible for financial support and participation in elections.

This would help reduce the possibility of dubious personalities appointing themselves as party head or too many small parties getting listed on ballots.

The EC is expected to look into the matter next week. The three other parties that filed a petition to the Constitution Court last month were the Ratsadorn Rak Thai Party, the Sangkhom Thai Party, and the Naew Sangkhom Prachathipatai Party - each with fewer than 1,000 members.

Yesterday the EC decided to propose the winding down of ten small parties for failing to report their political activities as required by Article 42 of the Political Party Act.

One of the ten parties is the Su Phue Thai (Fight for Thai) Party, led by Chuwit Kamolvisit.

3 parties join hands fighting dissolution charges

Agriculture and Cooperatives Minister and key figure of the Chart Thai Party, Somsak Prissanananthakul, says three parties facing dissolution charges are discussing guidelines to defend themselves in court.

Somsak stated however that the three parties, including Chart Thai, People Power, and Matchima Thipataya, are not exchanging information of their cases, but sharing trial strategies. He said he believed that that the three parties working together is better than them working on the cases separately.

Election Commissioner Suthipol Thaweechaikarn said the Constitution Court and the Attorney-General have yet to contact the Election Commission (EC) to ask for evidence and EC’s appearances as witness in court. He said the EC will definitely do so if requested.

PPP ready for dissolution verdict

PPP MP and Truth Today program co-host Jatuporn Promphan admitted on Tuesday that the court may rule for the dissolution of the government-leading PPP, but said it would not affect much because the party members are prepared for it. "Once the date for the PPP to be disbanded is known, the Party will select a new PM who is not a PPP executive. Thus, the dissolution would not affect much, adding that the ruling Party does not have high hopes to exist after the court’s ruling because the process is distorted from the beginning," said Jatuporn. According to the MP’s claim, there are some people who want to eliminate all members of the PPP by using the PPP dissolution case and the Preah Vihear case. He said the Party would like former executives of the disbanded TRT Party to help administer the country, but they have been banned already. Jatuporn said he does not rule out the idea to introduce ousted PM Thaksin’s sister to lead the Party, should other PPP members such as Mingkwan Sangsuwan, Police Captain Chalerm Yoobamrung, and Santi Promphat be implicated in the Prear Vihear case. However, he said all PPP members agreed that dissolving the Parliament would not be a solution because old problems, such as the PAD’s anti-government movements, would still be unsettled. On Thaksin’s phone-in address on December 10 at the mobile Truth Today talk show in Supachalasai Stadium, MP Jatuporn said people would know his political stance clearly.

Suchart to lead Puea Thai Party

Deputy Finance Minister Suchart Thadathamrongvej was elected Leader of the Puea Thai party yesterday, amid signs a major faction in the ruling PPP is being isolated.

Puea Thai Party is viewed as the fall-back Party if the PPP is dissolved by the Constitution Court. Suchart's nomination for the leadership was unchallenged.

The meeting, held at the Party's headquarters in the Shinawatra building on Rama IV road, also elected former Interior Permanent Secretary Yongyuth Vichaidit and former Forestry Department Chief Plodprasop Suraswadi as Deputy Leaders.

The Party was co-founded by politicians with close ties to some of the 111 former executives of the disbanded TRT Party, who were banned from politics for five years. A source said they include Pongsak Raktapongpaisal (TRT Banned #27), Yongyuth Tiyapairat (PPP Individually Banned), and Sudarat Keyuraphan (TRT Banned #3). These former TRT executives are believed to have a strong influence in the PPP, but are reportedly up against another faction controlled by Newin Chidchob (TRT Banned #6), also one of the 111 TRT executives.

A source said Puea Thai is a consolidation of MPs with clear links to the TRT, and it may be drawing a line to keep the Friends of Newin faction out. Suchart said his Party was prepared to run candidates in the next general election and he was ready to be prime minister if the party nominates him.

Wattana Sengpairoh, a failed PPP MP election candidate, said if the PPP is dissolved because of the vote-buying by Yongyuth in the December general election, Suchart was well suited to succeed PM Somchai Wongsawat. Puea Thai Party member Surachai Baojanya said the Party would be popular with voters as they know it is a rebrand of the "old party," a reference to the TRT. A source in the PPP said some members of the Newin faction were expected to set up their own party, called Suwannaphum.

Puea Thai Chief set to step aside

Suchart Thadathamrongvech will step down as Puea Thai Party (PTP) Leader to prepare for the dissolution of the PPP and a new election, sources said yesterday. The decision was made at the meeting of the Party executive board on Monday amid anticipation that the PPP would be dissolved by the Constitution Court in mid-December for election fraud. The PTP sources said 12 executives will administer the Party until the new board, including a new leader, is appointed. PTP has been set up to accommodate PPP members who will survive any dissolution. Suchart, who is the Finance Minister, could not be reached for comments, but PTP Deputy Leader Plodprasob Suraswadi said after another meeting yesterday that the issue will be explained by Suchart himself. Kamol Bandaipet, a PTP executive, said his Party's restructuring was intended to accommodate not only politicians from the PPP, but also from the Chart Thai and Matchima Thipataya parties that could be dissolved as well.

PPP MP for Roi Et Sakda Khongpet said voters preferred any member of the Shinawatra family to be the new PTP Leader, whether it be retired General Chaisit Shinawatra, a cousin of convicted PM Thaksin, or Thaksin's younger sister, Yingluck.

But PM Somchai yesterday told PPP members at the meeting yesterday that the government would hold on to power as long as possible, with House dissolution being the last choice. PPP legal expert Choosak Sirinin said the Attorney-General has offered two options to the court in its recommendation on the PPP dissolution. They are either to dissolve the PPP and ban its 37 executives from politics or dissolve the PPP and ban only party executives involved in the poll fraud, he said yesterday.

Chart Thai Party's defence against dissolution coincides with its 34th Anniversary

The Chart Thai Party has scheduled this afternoon to file its defence on the Party dissolution case at the Constitution Court coinciding with its 34th Anniversary celebrations today, Party Deputy Leader Nikorn Chamnong said on Wednesday.

The Party has been accused of linking to the electoral fraud committed by its executive Monthien Songpracha in Chai Nat during the December 23 general election.

of course, as everyone should have sorted out by now...he's NOT been "found guilty"... only indicted by the NCCC...same as the current PM, btw

If, by the book, I suppose the Democrats are responsible for the 150 million baht... and if the same book is used, after the People Power Party is dissolved, they will be responsible for the 3,000 million baht it costs for an entire nation re-election. :o
