Here's one for the legal eagles out there!!

In August, I applied for a Non Immigrant ‘O’ multiple entry visa from the Thai embassy in KL. I got a Non Immigrant multi entry visa, but it was a ‘B’ and not an ‘O’ as I had applied for. They gave me a ‘B’ by mistake. Now, with the changing of the law in November, I want to have a year’s extension to my visa. I am not working and have no income, but over B400,000 in a Thai bank. There are 3 questions I want to ask.

1. Do I have to change from a ‘B’ visa to an ‘O’ visa and then apply for a year’s extension?

2. Does the B400,000 have to be in an ordinary savings account, or can it be in a high interest/fixed/time deposit account?

3. Should I apply for an extension now, or wait until August 2009 just before the multi entry expires?

Has anyone done the extension in the last month? What EXACTLY is needed? Or should I just use Sunbelt to do the donkey work for me? They quoted B11,000 all in.

The B visa is not a problem. You will be applying for an extension of your permit to stay based upon having a child if I remember correctly. All you need is a non imm visa. See 2.18 of the police order for the requrirements.

When you go for the extension take the girlfreind and child along to show that you are living as a family.

What more that is required as far as documents go will depend upon the immigration office.

The basic documents are birth certificate, copy of passport photo page, visa, entry/permit to stay stamps, TM6., bank book and letter from bank certifying deposit in bank. Fixed term deposit shoud be accepted.

Girl friends house book, and ID card are in case items.

You do not say where you are at a lot will depend upon the immigration office you go to. Bangkok has already given these extensions under the new rules according to posts. And under the old rules also.

Pattaya is a problem because they want you to have sole custody of the child.

You shouldn't need Sunbelts help.

Memory failure. Now I remember it was the 400,000 change that helped you.

Change girl friend to wife and take out child. You will need marriage certificate and her house book plus ID card. Money needs to be in the bank for 60 days. Photos of you and the wife around the house and near/under the house number.

You can go to any immigration office. You will be given a stamp that tells you to come back in 30 days while they consider your application.

Does the letter from the bank and the updated bank pass book have to be dated on the exact day of extension application, or do they give you a few days grace?

I think I remember a story a few years back when a guy was knocked back cos either the letter or updated book didn't correspond with the day of application. Just wanna make sure, Joe.

Most reports are a couple of days but you never know what each immigration office may want. There was a report lately where an immigration officer wanted the bank book updated on that day. Member had go to the bank and made a 100 baht deposit so that it would show the balance on that day.

THe bank letter a few days is never a problem and the bankbook can be asked to be up-dated the day you apply. I have seen a few posts were people were asked to go to an ATM to get a slip to confirm their balance. But that is very rare.

I think I'll play it safe and get the book updated and the letter dated the day of application. So, to get from Silom to Immigration and apply for extension about 09.30 (instead of straight to Immigration at opening time), I'll probably be there til midnight!!
