I am going to buy a used car from a swiss man - and I am german

should the contract be in german or in english?

are there any forms of buying contracts available for download in the internet?

German should be ok as it easily understood by both of you. Just make sure he is the registered owner of the car which info can be found in the registration book.

No form is needed just write what you buy, how much you pay and make sure the seller gives you a receipt.

Pls notice you have to register the change of ownership with the vehicle registration office and a fee has to be paid.

Have you looked into the process of registering the car in your name after purchase, this would be one of my main concern's.

German contracts are not valid overhere. All contracts should be in Thai or at least english. Thai car sales contracts you should beable to find in Bookor statioary stores.

As far as a contract go's whenever i've sold a car a simple note drawn up on word with both names & address's date & the amount paid is enough but most of my friends in UK just stick the cash in their back pocket & don't bother to sign anything including the logbook which most still hand over in full to the new owner which is big mistake as your likely to remain as the registered owner in the eye's of the goverment with many fine notice's to follow, i don't think Thai's are much different in this regard & many do not even bother to re register.

A written agreement is always good to have. It states what the seller and the buyer actually agreed to. The most important thing is it is easily understood by both parts. As said before German should be ok as it is the language of both the buyer and the seller and threat it as a “single piece of paper” only. Forget about having it 100% legal as it is not likely to be used in a Thai court - they hate disputes in between farangs anyways.

I fully agree it is important to have the change of ownership registered with the formalities it involves.

Needed to transfer ownership of a vehicle (where buyer and seller are foreigners):

Seller provides:

Signed copy of passport, both picture page and visa page.

Proof of address, can be issued either by your embassy or your local immigration office.

Car owner book, signed at the proper place to allow transfer of ownership.(bottom middle of page with address of the last owner)

Thai language sales contract stating the selling price.

Buyer provides:

Signed copy of passport, both picture page and visa page.

Proof of address, can be issued either by your embassy or your local immigration office.

Notes:

-A work permit can be used in lieu of the proof of address paper.

-If the car is older then a certain age, a technical check up has to be done on change of ownership.

If I buy from a falang in Pattaya but live in Bangkok dowe have to both go the pattaya office to first deregester his ownership and then go to the Bangkok office to register in my name and does that involve a change of plates? The proof of address letters from immigration take 3 weeks so buying a car from a falang would be a long drawn out process.

If the above is the case then it becomes a huge hassle so what are the complications of not bothering with any of it. Does it mean later I would not be able to sell it to someone else?

I hear that many people do not bother registering so what do they do when they want to sell?

Yes... anything that is out of your licensing Province = change of plates........ It is very simple you take all the paperwork in pay 54 baht, go back with the car 7 days later, take off the old plates [TAKE a screwdriver with you] + the road tax, take it in, you will have to pay for a new 1yr road tax before you can get the new plates, if the car is old then you will need 1st to drive it into the test bay...... It is all VERY simple to do, just takes time, but you come out with the blue book in your name at your address, new number plates and 1 years road tax disc

Many people will use a TENT seller, this then need the proof of address, passport copies from buyer and seller, sales forms, chassis numbers etc, but you just pay a fee and collect later when done.

Myself registered at the Town Hall 5 years ago, so if I need proof of address, it is simple, it is on there Computer they put on the date print out and then I take it to the Junta for the big red seal...... cost nothing and takes all of 5 mins to do........ NOTE this type of proof of address is fine as long as it is within your Province.. If it is out of Province then you have to wait the 3 weeks for the letter from Immigration or pay an arm & leg for the bit of paper from your Embassy.

Can you tell me if the seller must go to his registration office first to deregister the vehicle?

If not then would I be right in assuming all I need is a sales contract, sellers copy of passport + my address proof and the blue book?

Make a very simple agreement (its called a presale and prepurchaseagreement) in english (or better in thai) who sells the car and who buys the car and the chassisnumber of the car. Copy of passprts. A small deposit, max 10.000 baht. Pay the rest (with a cashier check) when the seller and you have transfered ownersip to you, aka the book with all required docs are accepted buy the government office. a week later you become the actual owner of the car.

Transfer of ownership has to take place while the seller still has a valid entrystamp in passport.

If you only make a contract and the sellers permission to stay expires, transfer of ownership will be denied by government.

I have had my car for 3 years, blue book in my name and all, but still the same original license plate.

Transfer vehicle ownersip from another province is supposed to change plates and book. But you dont have to pay for new road tax. A new tax sticker in new province is issued as long as your old is valid.

I have had my car for 3 years, blue book in my name and all, but still the same original license plate.

My present car I bought in the next Provence, and had to change the number plates....... This is doing it yourself, I believe if you get a Dealer to do it then you keep the old number..

Not true in my case, when I bought my present car the old owner gave me a brand new 1yr road tax, there was sill 5 days left on the old tax, yet I still had to pay for another 1year road tax when I had a new 12 months car tax.. They said there was NO refund,...

I have always found Nontaburi Center very helpful and everything is done in English........ They did tell me that I could drive the car without changing it into my name until the road tax was near the end.

Somethings are a bit odd, maybe someone can explain. my present car now has Nontaburi plates, yet my Truck I bought on 16 May last year from the Isuzu dealership just down the road has BKK plates.... why did it not have Nontaburi plates?

In this Village there are 63 houses, most have 2 cars, yet my car makes No 5 with Nontaburi plates all the rest have BKK plates. Edit at least 40 where bought brand new yet have BKK plates

And you will never beable to sell the car again. Worster Scenario: "Accident" Only the owner in the book can release the car from the Police Station. So if it's not in your name......................

Nobody, want's provincial plates. BKK Plates are more common, easy for changing ownership and higher resale value, because it is common for Locals to use BKK Plates. It's a better "Look" than some Isaan Plates, for example.

Could someone tell me what is involved for a farang to purchase a car from a Thai? I read in another post that I need to have a Certificate of Residency and photo copies of my passport. Anything else I should know?

never heard of such contract.. an invoice and reciept to show proof of payement is standard, unless he is giving you terms in which to return it which i doubt

If the thai registered owner goes with you to transfer, thats all YOU need. The thai needs to bring the vehicle and the book. If the vehicle is registered in another province than your certificate of residence, you will only request for a transfer of province first time.

A week later you can request transfer of ownership, and have the vehicles identity (VIN) inspected. Thai owner needs thai id card and tabien baan. Copy Tabien baan needs to be signed by the first resident. Done :)
