Would he be bright enough to have got a 90 day Non-Imm visa ?

Its so rare one will be arrested to put in detantion for overstay. I have so many friends over stay every time by 10-60 days for past many years. I have overstay about 20 times in past 20 years, longest one is oversaty about 65 days. I still have not actuaally met a single person who was arrested and put in detainment for overstay. I would say the chance of getting arrested for overstay is almost like winning a big lottery if you don't behave like crazy drunkard to get arrested on purpose. I and all my other friends will not worry about overstay for a week or 2.

I must say that however stupid the advice is, it may have some elements of truth.

You can extend beyond the 90 days (by 14 days) by going to Thai immigration BEFORE your 90 days are up. It costs 1,900 baht. (but marginally better than the 2,000 baht at the airport for the 10 day overstay, as even if you are stopped by the police you won't be on an overstay...)

I admit - I've never been asked for my passport by a police officer, but I wouldn't want to take the risk...

He'd go straight to the Immigration Detention Centre and ultimate deportation to his homeland.

I do not mean to reccommend visa overstay. Only want to say do not get overwhelmed by worries of overstay for a few days or so. Because realistically speaking the chance of getting detained in jail for a few days overstay is almost zero. But do not overstay if you can get a visa run.

There are now many budget airlines from BKK to border cities. You can enjoy a small trip and also obtain a new visa. Airasia(the cheapest) now flys to:

(1) Udon Thani-can go to Laos in one hour from Udon via Nong Kai.

(2) Hat Yai- can go to Malaysia via Padan or Dannok. Only less than 1 hour to border. No visa fee to enter for most nationals.

(3)Chiang Rai-go to Mai Sai to cross to Tachiley, Myanmar for a day trip of 5 USD.

One hour to border from Chiang Rai.

(4)Ubon Ratchatani-go to Laos vis Chong Mek. One hour by car to border from Ubon.

Visa run is now cheap and fun with the budget airlines especially Airasia also flys from BKK to neibouring Singapore, KL, Penang, Macau, Kinabalu, so my real advice is to make a fun visa run before expire your visa so you don't have to worry about the unexpected police raid mentioned by other members.

It's not just a "police raid" that can get you caught. Hire a motorcycle and have a small bump with another vehicle - not your fault. You'll still be asked for your passport.

A few years ago, I was minding my business in a bar during the afternoon. There was a tap on my shoulder and it turned out to be two Tourist Police. They were checking on farangs who they knew had been in town for some time. I had to go home to get my passport. Everything was in order. I had overstayed a few times before this incident - never again. You just can't tell when it's going to happen.

Well, FWIW, I know 2 people, both of whom have children by Thai girlfriends, who are in jail and have already spent 3 months, waiting for release. NB I am informed by lawyers that *if* you go with a lawyer to Immigration, *with your airline ticket and bags* you will be fined considerably less by the court, then have to pay to be transported to the airport and escorted to the gate. So, if you pay a lawyer 2,000 Baht, and the court fine is 4,000 Baht and transport is 1,500 Baht +/- then you MIGHT be able to save 50% over the 20,000 Baht fine at the airport.

I think overstaying is a very bad idea, OK unlikely to get caught but still doesn't look good in your passport. There is so many way to legitimately stay, that it is just madness/laziness to overstay.

As a guest in a foreign country, it's always solid advice to follow the rules.

As all the budget airlines have multi-tier pricing, I found Nok Air to be generally cheaper and much more relaxing than AirAsia because of it's assigned seating, instead of AirAsia's non-air-con-bus-like general seating. Another incentive is a distaste for AirAsia's owner, Toxin.... I figure he already has enough money without my supporting him.

You only feel it's not necessary to alwasy keep your visa up-to-date, alohasiam, because you don't know the consequences of being caught without one. You are deemed an illegal immigrant and to not care about Thai law! I overstayed by a day a few years back and got the big-assed stamp in the passport. Nearly overstayed again a few months back, albeit by only 8 hours, but decided to pay the 1,900 baht and extend.

You never know when a copper's going to stop you - the passenger on your bike may not be wearing a helmet (although, you'd get away with just paying the fine) - but it just is not worth the anguish of if and when you get caught.
