Fairproperties Is Keeping Money From The Rentals Of My Condos, What Should I Do?

Send them an email and fax telling them if they dont pay everything they owe by a

given date and time you will have a member of your family stand outside their office

to hand out a sheet of paper to every person that comes to their office with an

explanation of what they have done to you in both English and Thai and that

Pattaya People and Sophorn Tv news have agreed to cover this being done ! :)

My ex-wife currently rentsout two houses. The leases on both expire next month and the renters will be leaving.

Both houses have a 180,000 baht deposit owing,which I know for a fact that the ex-wife no longer has.

It will be very interesting to see what happens when the renters want their deposits back, the ex all along considered it her money and has no intention of paying it.

I feel for the renters as some Thais have no idea what the real world expects. To be honest I hope the renters take it all the way to court, if only to teach the ex wife a lesson...she is not the centre of the universe and other people do matter, just because she says something doesn't mean it is true etc etc...

Ya some thai with money have no idea how business works. :)

I hope you get every last satang back - this sort of business operation really sux and should be closed down. A couple of tips from one who has pursued money from turkeys like this:

1. never release the pressure on them even minutely until such time as you have ALL your money back. In fact I recommend a process of slowly/gradually/regularly winding it on. eg. every monday make a point to write a post in a new thai expat forum telling of your experiences etc etc. I am not sure what you meant about "giving them more time". If they think you will drop the ball then they will proceed accordingly (and stall, duck and weave, etc). If you don't have the time (a lot of it) and the writing skills then that's where a (good) lawyer may be worth the money. get a personal recommendation, not some wally you found with google.

2. once you have commited to fight for your rights then be very careful in everything you say or do. assume for example that every email or letter you write will, at a later date, be read by a magistrate - and write accordingly. never abusive, never exaggerated, never anything that could be construed as threatening them with violence, etc. many people in your position come unstuck this way - they start off 100% in the right but then blunder and end up giving ammunition to the people they are pursuing and completely undermine their own cause.

3. as others posters have suggested formalise every step with registered/witnessed letters. as well as being good business practice this tells the turkeys that you are thinking and are serious about getting your money back - not just some mindless ranter

I"ve had good luck with physical presence.I'm quite muscular so I put on a tight shortsleave shirt pump up and just get in the thais face.They usually shit themselves without me doing anything. :)

I just wanted to say that I did contact The division of Consumer Affairs in Bangkok. I explained what Fairproperties had done to me. I never got a response back. I hope they did investigate, but haven't a clue if they did or didn't. I'm glad I took all the keys away a while back. Some others might have a problem if they skipped town or are hiding. It's all very strange, I mean if you go to their web sight you get a TROJAN, sounds to me like they angered some computer savy geek. I'd like to shake his hand and buy him a beer!

Does anyone know if Fairproperties is still open and carrying out business as usual. I would appreciate an update.

Fair Properties was supposed to put 8,000 a month in her bank account. They have not done so for nine months, effectively stealing 72,000 baht from her. She wants me to leave at the end of my lease so I must look for a new home.

When we went into the Fair Properties office for her to notify them I asked about my 20,000 baht deposit. I was told "must check with boss". I am going back next Monday to see if I have any luck.

You will not get your deposit back until you have moved out and it is established that there is no outstanding bills or damages.

I have until 31 October to move out according to the owner. Until then the owner had a Thai man with her who she identified to me as her new agent. I am to pay the rent to him and contact him if I have any problems. Since Fair Properties has been dismissed (in my presence) as agent why should they hold my deposit? I do understand why the lady who was alone in the office would want to contact her boss before making a refund to me.

For what it is worth I have been here three years and have had zero problems with Fair Properties. Also I was thinking of moving at the end of my current lease anyway so having to move is no big deal to me.

It's not worth anything seeing as you ain't the owner who is being stiffed.

Foxx I don't believe that I'm the first one that Fairproperties has stolen money, but it does seem odd that I hadn't heard about it before. I obviously would have chosen another company. I had a feeling that something was wrong last year, when I had gotten e-mail acess to my thai bank account. I found out that no money was in the account, but the condos had been rented. Fairproperties said that the person that was in charge of my condos forgot to put the money in my account. Tung the owners wife, I believe said that they were sorry, and it would not happen again. they did deposit that money. They also agreed to have the money put into my account within 7-10 days of receiving it from the client, that promise was never kept. I had to repeatedly e-mail them and have my wife call them to ask them to put the money into my account. Every month it was the same story the person in charge of your account is out sick, they next week their on vacation time off etc. till it was the end of the month then the money was put into my account usually the last week of the month. Now, here we are and they haven't put money owed 2months worth of rental into my account. They ignore my E-mails and don't even respond. You know hind sight is twenty -twenty, that saying applies here. Last year (when they forgot to put my money into my account) a dozen redflags went up, but I ignored them. Now I'm paying for that. Everyone here take warning, Fairproperties is a corrupt organization run by a falang, and they will steal your money. I have learned the hard way ! Take care, David Henault

David, seems you have a copy of my story with FP. I made 100% the same experience and even found last month that my condo was rent out without my knowledge and -of course- no payment to me until today.

Lots of emails with "Laddaporn" saying they will pay me, Em not there, Yupin not available right now etc, no more replies since february 27.

Yes must be common problem.

I have been looking but still can not find at the right price a data logger (with date and time recording) that will either log when the door opens or logs electricity usage each hour.

Maybe a good business opportunity, a security company who visits properties twice a week to check they are secure and see if it is occupied, with labour cost so cheap must be a winner.

If this all is true, then I really ask myself how the hel_l they can stay in business.

They do not do it to every account is my best guess, that would be very stupid. They do it to a certain number of foreigners, usually the ones they know live out of country. David H

Personaly I had a very good experience with this company two years ago. It might be that my wife is thai, but the impression was still good. Of course, a lot of things can happen in two years, and I did notice a long delay in new condo postings on their webpage at the start of "high season". BTW, I got my deposit back in cash. Is there anyone that got their deposits back recently, because if this was a company in trouble it would be the rule and not exeption. Otherwise mistakes do happen, and communicating with thai is not always error-free...

My friend could not get his THB110,000 deposit back one year ago from Fair properties also the owner of the condo said

Fair Properties had not paid him the last two months rent (another THB110,000) Fair P just said they did not have any money.
