I am 54 years old. The children are 12 & 8. They have lived with me since divorce from my Thai 3 years ago.

Now I am on a work permit, which expires in 2 weeks.

I need to sort out another visa.

Your best bet would be your home country or a place like Australia. Very hard to do near Thailand without showing money.

It may be possible in Penang or KL. In Australia Perth would be favourite.

If not, with Thai children custody, can I get single entry (3month) renewable non-imm O, (without showing 40,000/m or 400,000)?

...& keep going out-in? Or is the rule the same for single entry?

Can I do single entry in Cambodia or Laos.... or does it have to be Penang?

Or maybe go for triple entry Tourist (3x2months), then move to Non-Imm O again after Tourist visas are stopped?

Have you spoken to immigration yet? I,m in a similar position.Have a 7yr old daughter and married.My visa also expires in 2 weeks.I was at the local immigration office a couple of days ago.

Last year i got a 1 yr extension based on having a thai child and didn,t have to show any proof of income, but they asked how i was managing to live hear. As i was teaching and have been living here for around 10 yr it pretty straight forward, just a lot of extra paper work for the immigration officer.

But this year they're asking for proof of income or money in bank.

Point is i believe this visa based on support of thai child is there for cases like yours where the children are living with you not the mother.

So if you can show immigration how you and your children are surving here on what ever money you have or can earn.It may be possible to extend your visa if you already are on a non imm visa.

Just my immpression based on my experience. I think i could renew my visa if iwas now separated andthe children were living with me.

When i was at the immigration the other day.They asked me why i don't get a visa through the school i work at. I said i don't want my visa tied to a school, as if you leave the school i think you have 10 days to sort out another one. They then asked which visa i would like to apply for

anyway as soon as one says your still married and living together as a family you cannot claim a visa based support of thai child it is treated as a marriage visa

Yes. This is what it says which leaves you at the mercy of each Immigration Office.

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

In other necessary circumstances, The Immigration Commissioner or Deputy of Immigration Commissioner may approve on case to case basis.

I read it that you can appeal to the head of the immigration department or his deputy to deviate from the rules. That would in all likelyhood only be in exceptional cases.

I forgot to say that I now have Non Imm O, (not Visa.

I called lawyer SUNBELT 02-6420213. He said that I just get letters from the 2 Thai schools, where my children study, (that they are registered there). Then go to Nan with custody papers etc for extension 1 year.

The lawyer sounded VERY sure of himself! So get the school letters Mon, Nan Tues..... then see how it goes...

I will report how it goes of course.

Another thing - I also heard that, being over 50, you can get 1 year visa for your your children supporting (without anyone showing money in bank)..... but I need to wait another DECADE for my kids to start working (shelf that idea!)

Hi. I know that this is a kind of strange. The best thing would be to look for a new job. It's possible to get another 3 month Non-O in Laos, (best in Vientiane). Normally you have to show 400,000 baht on your bank account, that's true. If that doesn't work, can't you get a via in your country? Don't get me wrong, but 90 days are passing by very fast. For marriage visa, Thai immigration wants to see 400,000 baht in a bank account or 40,000 a month income.

I think most foreigner's can earn 40,000 a month if they live in Bangkok, but what happens if your wife's family is from Issan. Many of the same jobs do not pay the same in different parts of the country. The cost of raising a family is also cheaper in the North-East.

If they want to use 40,000 baht , then wealthier regions could use this level whereas poorer regions could be ajusted accordingly. I don't know know of a single thai male relative in my wife's family making 40,000 baht a month.

In her family half of the males are older and the other half are younger. I can easily put 400,000 baht in bank account to get a visa, but if I had to find a job that pays 40,000 baht a month in Issan, that would be very difficult.

All her male relatives have wives and children. They are doing okay, but I know none of them are making 40,000 baht a month.

I hate to see you have kids and a problem. I have the number for a lawyer I was introduced to by officials AT the immigration dept. that "suggested" she could help me with what I wanted to do. She may be able to help you also. It may cost you 10-20k baht in "fees". PM me for more info.

Apply for annual extensions to live with your Thai Children.

Here are the extension rules. Look at 2.18(5)

When we did our child's Aussie citizenship and passport back in 2002, she was only 17 days old then, by memory our doctor signed the back of her photo for both the citizenship and her passport. We had out Thai doc's translated and that took one day, i.e. handed them in in the morning and got them back that afternoon. As for how long the citizenship papers took I can't remember, I just renewed my passport and that took 10 days. As for appling for citizenship by descent for your child, only one parent needs to be Australian, regardless if you're going to Australia or not, your child will get it as long as your name is on your childs birth certificate, that 's very important. Once you have that than the passport is no problem.

January Penang wanted you to show 800'000 for multi entry to visit your kids even when you were married ,while, when I called K.L they only wanted you to show 100.000 ,seems Penang is a waste of time these days hardly any one gets what they apply for

I was told last week by samut Prakan Immigration that the law had now been changed back and you can keep re-entering on a 3 month visa with no requirement for staying out the country for any specified time.

Singapore now only give 3 month non immigrant O visa's (no yearly) proof of income not required, apply in the morning and pick up the following afternoon.

Yearly visa's only issued at country of origin, no proof of income required

There is no limit on back to back Visas. Multi Entry Non Imm O Visas are available in neighbouring countries if you qualify . As said before, KL seems favourite.

1. exit work permit & 2. extension non imm ‘O’:

My work permit & non imm 'O' visa expired on 31/3/09, so on that day I went to the Phrae labor & Nan Immigration.

This is what happened…

1. EXIT WORK PERMIT…….

- get a document from the school to get a tax refund (I got 7000bt refund)

- get the school to fill in exit form (from labor office), with school stamp & Director’s signature

- on last day of contract, hand in this form with your finished work permit at labor office & get a receipt

- then go straight on to your immigration office

2. EXTENSION NON IMM ‘O’……..

- NO for 1 year extension to live with my children without 400,000bt….. & NO EXCEPTIONS, (say their bosses in CM)

- YES for 60 day extension without 400,000bt - 1 time visa 1900bt. (Does that mean once per year?)

- don’t try in Bkk (they said), because u hav 2 apply at the appointed office for your area

Documents…

- receipt from labor office for exit from work permit

- they didn’t ask for any tax things

- Original official stamped letters from both my kids’ school Directors, certifying attendance

- Copy divorce cert.

- Original Thai ampur divorce document & original lawyer company divorce contract…. Open at pages about custody of the children,…. but they read it all (they were amazed). They asked for a copy of both documents.

- Original bank books of 2 Thai accounts & copy of 2 uk bank account statements (they laughed!)

Go out at Maesai for 2^nd entry 2m (sept & oct)

1m Extension in Thailand 1900bt (nov)

3 border runs to Maesai for 15 days trip costs 2000bt (dec)

That’s 9 months already at expenses 1+k/m

A few people told me that I can then just keep going in & out every 2 weeks at Maesai (Burma day-pass 500bt) back-to-back ad infinitum (they currently do this).

Can anyone confirm this, please? And is this plan workable?

Yes, you can get a double tourist visa for free from vientianne and go ahead with your plan.

Agreed, if you were working. In my case, income comes from within Thailand from rental of three condominums and dividends from Thai companies I have invested in within Thailand. I had all of the documents proving ownership of these investments and property as well as Thai Tax records for the previous 12months showing income and the tax paid on this income and still they refused to acknowledge that people can earn income from investments and said I need work permit !

In the future I might just get a letter from the embassy, much easier and at least embassy staff seem more intelligent than immigration (even if they are as unfriendly). Otherwise, the most recent police order says that you can get special consideration by writing a letter to the Commissioner, or deputy Commissioner ? (seems a little high a rank for a simple visa ext. - but I don't know)

The new rules that came into effect in November says both.

Also there no time in the bank requirement for the 400,000.
