Hi forum

Im hoping someone out there may have the answer to a question that is increasingly concerning me. My newborn son was born in thailand in Bumrungrad to my thai fiance in January, the hospital did all of the thai birth cert and tranlsations etc.. I have all of that paperwork, however the one item I am missing is my divorce papers (decree Absolut) im currently going through the divorce in england and am worried that it may drag out beyond 2 years...Now, if this is the case..do I miss my chance to register the birth of my son and apply for his passport?

I just need clarification on this matter and would really appreciate it if anyone has any comments or advice regarding this, I can prove I am going through the divorce as I have masses of paperwork supporting this, however is it a total neccesity to have this final document, because my son is mine and can be proven by DNA etc so I cannot see why they shouldnt allow me to register him, just because i'm technically still married in england (we have been separated for 2 years now and the divorce commenced last october).

That it in a nutshell and so any advice would be fantastic. many thanks

Under Thai law you needed to register the baby yourself to have your son legitimised and be the legal father. However, once you get married with the mother, under Thai law you will then have legitimised your son.

I'm having exactly the same situation.

I was legally married in Europe (with a thai girl) but I'm not yet divorced although we been separated for the last 4 years on which the last 2 I been with my current partner and the mother of my daughter.

Does that mean i cannot register my daugther to any embassy (I've got Italian and English passport) untill i will be legally divorced?

Under Thai law you needed to register the baby yourself to have your son legitimised and be the legal father. However, once you get married with the mother, under Thai law you will then have legitimised your son.

Having done more research and with the massive help of this website I am reassured that the main document is the passport and also that if my son (or daughter) in your case has a thai passport that is witnessed and also signed by you and your fiance, I understand that this also carries weight. You can still obtain the english passport too and this is of course the important bit as it means child can get to the UK.

I am planning on marrying anyway in oct/nov and so the other question is also answered regarding legitimizing the child.

The final point and its just an aside really, when my fiance went and banged on about going to see a jusge straight after my boy was born, I now realise it was the local Amphur i had to visit, even tho bumrungrad i thought were awesome in completing the birth cert etc, (which I signed) I hadnt realised that I had to go and register with my fiance personally, it sounds like itll be all well that ends well, but just wondered and im sure its the case whether others have had these kind of misunderstandings with there mrs' with the naming of things n places :o

One thing, my daughter also born at Bumrungrad last week and i filled in the form regarding her birth certificate along with copy of our passports and tabien ban.

As you said, do we still need to go to the local Amphur to register the baby?

And which documents do we need to bring along?

Is not enough the birth certificate they give you at the hospital?

Did you eventually manage to get your son a British passport?

If i'm right in assuming that your unmarried to your current partner then i would suggest that yeh you do ned to go with her to the Amphur to register and legitimize, however if you plan to marry her anyway then that also automatically legitimizes your child, My understanding is (and I could be wrong) that you only have a couple of weeks in which to go to the Amphur, I think i've read that in another thread on thai visa, also my fiance insists that this is the case.

I'm due to travel back over towards the end of april an she told me couldnt go see the 'judge' now because it was too late to do so, I was bricking it until last week when i was reassured that the marriage sorts that out!!

As for the passport, Havent done it yet, this is part of the reason for the next trip over there, seems the main hurdle to overcome is getting the back of the photo signed, i dont know of anyone with high standing in thailand who is english that i've known for 3 years, so I'm having to have the photos sent back over here to have my best mate who happens to be a copper sign the back of em, then take them back over with me in order to apply, from what i can tell however the whole UK passport application process seems quite straight forward.

One question I do have if anyone can answer is the following..is it ok to obtain both a thai passport and an english passport at the same time? I assume so but just wondered what others experiences are of this?

There is no problem as to having to passports for the child. In fact it is very handy when traveling between Thailand and the UK, as it shoiws there is no need for a visa to enter either country.

Great news that Mario, I wasnt sure if having one had any impact on the other now i know thats not the case its another worry that can be crossed of the almost endless list lol.

Wow finally seems like am getting closer to having my wonderful fiance and child back with me in england!!
