The Entry Clearance Officers decision: I Have refused your visa application without interview on this occasion because I am not satisfied, on the balance of probabilities, that you meet all the requirements of section 41 of the immigration Rules in particular, sections (iii). This decision was made on the merits of this application. However, If you have a previous application and immigration history, this may have been considered. I have also considered your application under paragraph 320(11). ------------------------------------------------------------------------------------------------------------ My now wife and I have been together for 2 years and living for 1 and a half years under the same roof, which they donot seem to believe as she was wanting to stay off the radar. we left the uk in April together and voluntarily so that we could get married and legalize her stay. On a plus not I do have a appointment with my MP for next wednesday which all being good will help me with overturning the decision, but having trouble understanding the legal jargon as stated above. tjthai Posted August 18, 2009 Share Posted August 18, 2009 uaelaelil From a quick look at the rules where as you don't think the ECO believed your relationship it actually appears that the ECO believes your relationship was based on your girlfriend (now Wife) being in the UK on a Visit Visa and therefore not allowed to work (section 41 (iii) and that, I assume, she was there longer than the 6 months visa hence Section 320(11). You say that she wished to 'stay off the radar' which seems to confirm my thinking? This is just my take on it based on what you have written here but please post with any additional details as there are qualified advisors here too...obviously, if you wish I wish you both luck and hope the meeting with your MP is positive. Not quite. A refusal for a previous overstay would be under Para 320(7B), and Para 320(7C) says that this would not apply to a settlement visa for a spouse. To refuse under Para320(11) the ECO must have evidence that the applicant has previously contrived to frustrate the intentions of the immigration rules; for example, previously entered the UK illegally. See this thread and this one for more discussion on this type of refusal. Uaelaelil, if you wish to appeal against this decision, you must submit the appeal notice included with the refusal notice to the embassy within the time limit; 28 days. What I was trying to get at, without delving into an area I know next to nothing about, was simply answering uaelaelil's point about the relationship. It appears, from the paragraph, that the relationship wasn't in question but rather perhaps the relationship was in the UK with some question over her status during that period. Only my assumption about the overstay but the mention of 1.5 years under same roof and keeping off of radar made me think that perhaps uaelaelil's gf had worked in the UK, hence the mention of Section 41 (iii) about not working on Visit Visas? If staying together, and not leaving the UK for a period how would that be possible without an overstay? Anyway just my thinking on uaelaelil's situation but having little knowledge of the rules I'm certainly not going to start advising other than to say get professional assistance with an appeal. uaelaelil, I do hope your appeal is successfull and hope you understand that it is an interesting topic and one that alot of us here would like to understand more about. Basically, we followed Rob's Guide in the stickies, customising it for our situation. Best of luck to all those still waiting and appealing and thanks for all the advice given before we applied. Was hoping our daughter would be able to start school this September but after looking at the process times seems no chance of that now. You should still start looking for a place for her, she can start school as soon as possible after she arrives; she doesn't have to wait for the start of a term. Remember that your LEA are obliged by law to find a school place for her; and you are equally obliged to send her (assuming she is under 16.) My daughter-in-law went to the VAC in Bangkok this afternoon, 19th August, handed over the printed application (electronic one sent a few hours earlier with the fee) and had her finger prints done. In case it is useful to anyone, here are some details: I made up a concertina file of all possible documents from the official list and many others besides. Because I learned here that the VAC staff take everything out of any container and put it into their own boxes, I labelled everything meticulously and clearly, and stapled together all papers that had to stay in order, and put most documents into open sided plastic envelopes, also clearly labelled (someone here said they don't like the plastic envelopes that only have one opening at the top, which is understandable). They did want everything removed from the concertina file, but my dil calmly insisted on taking them out herself one by one to place in the VAC box in order. Apparently the member of staff could not get over how clearly and neatly everything was displayed, and kept showing them to her colleagues in the same room. I know they are not the ones who take the decision, of course, but it can't hurt that they considered this to be an exceptionally well-presented application. Although she had not made an appointment, she had to wait only 45 minutes to hand over the documents and do her biometrics. This is a difficult application because my son is partially disabled, lives on housing benefit, works as a selfemployed computer supporter at the lower rate of 16 hours a week plus tax credits, and has a vanishingly small income. We are confident about accommodation (landlord's letter of permission, enough rooms) and relationship - the main worry is income. However, even after removing living expenses, the remaining money is JUST above the target of a couple on job seeker's allowance: £100.95. So if they apply their own rules, it might be all right. I hope we don't have to go to Appeal. One point that might help someone is that they had a problem with proving that they have kept in touch during long separations. Since marrying in Feb 2008 (after a well documented 2 year relationship in England) he has been able to make only one visit back to Bangkok. They talk to each other constantly (daily, hourly) by Skype so have no phone bills to show. Apparently there are almost insuperable problems in printing out informative Skype logs to prove these conversations, but he has managed it. There is a forum about exactly this problem of proving regular contact now that most people use Skype, and their advice was helpful. Good luck to everyone else waiting for news. Enquirer I submitted my visa application in a file with only one opening at the top. it has alreay been through the system before , its the same one that i used for a Holiday visa last year , just updated, hope that does not go against my application. Actually we have a place for her already in a good school, we went back as a family (I have 2 daughters one is only 2 though) for 5 weeks over summer. I have lived in Thailand for the last 7 years so wanted to go back and suss out schools, somewhere to live etc however in hindsight I would have been better applying earlier however I did not realise it would take so long for the process. Our application is so bulky (trying to make up for the lack of income by using other arguments) that I imagined the ECO becoming irritated with the plastic and perhaps not bothering to look at some of our stuff. Anyway, I'm getting worried now - the fiancee's flight is next friday and we've heard nothing so far. Globaleyes' application went in a day before ours and his came through on Monday... It looks like recent applications (May,June,July onwards - including my wife's) are getting a decision around about the 10 week mark from date of submission.
