Subject Retirement visa to Married Visa Pattaya

Recently a friend wanted advise about Retirement Visa to Married Visa and I advised to to look up Thai visa. He did and printed off the regulations as at November 2008

Later using this advise he went to see his Visa Company – He has always used a visa company to obtain his visa and boasts that he has actually never visited Soi 5 Immigration Office . The visa company told him that Pattaya Immigration do not want to process Married Visa’s and are insisting that they will not take pensions into account but that you must have 400,000 bt in a Thai bank for three months prior to applying They then offered to sort a visa out for him for 20,000 bt.

Previously I had a married visa for 2 years then on the advise of Pattaya Immigration changed to a retirement Visa using a combination of pension and savings . Now because of the exchange rate I wanted to return to a Married Visa based on my pension

Is what the visa company which is a large one in Pattaya correct If so then I will have to consider an Ed visa or paying a visa company 20,000 bt and is that legal?

This is the law.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

This is the law.

Yes. Unless Pattaya Immigration are making up their own laws. We do know that Pattaya are insisting the money being in the bank for 3 months even though the law is 2 months.

To be blunt, anyone willing to give someone 20,000 Baht to do something they can easily do themselves for 1,900 Baht deserves to be ripped off. Sorry.

Here is the official law again.

2.18 In the case of a family

member of a Thai(applicable only to parents, spouse, child, adopted child or child

of his/her spouse):

Permission will be

granted for a period of

not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Here are the Extension Laws in Thai. You can let your Wife have a look. You need Rule 2.18 (6)

My Humble opinion visa companies are a waste of your good baht, the rules/laws, fees can be found here on TV or other web site. I would suggest to all get them read them and apply them, for sure when you get to Immigration they will ask for extra copies of something or the other, but that is in most case minor and just a matter of going and getting it. Sounds like this visa company is give your friend a lot of hogwash, :D oh well you get what you pay for and seem as if your friend is willing to pay for it. :o:D
