Hi everyone, I just want to solicit advised and help in the steps to be taken here is my case:

  • I am resigning with my current job this April 30, 09'.I have a Non-Imm. B VISA which is valid until December 2009. My work permit is valid only until April 12, 2009. I have this receipt of notification document which states that "it is not an extension of stay please notify your address again on May 18, 2009" KEEP in PASSPORT. On April 17, 2009 they have asked me to sign documents for extension for they want to grant me 1 year WP and processing for extension will be done on the 20th of April 2009. I decline and informed them I will resign on April 30, 09' no need for them to extend me up. On my resignation on the 30th of April I requested them to cancel my employment WP with them on 30th of April 2009.
  • He informed me that I should go to the Labour and notify for the cancellation of my WP and once I done it inform likewise the Immigration for my VISA will also expires.

I hope i did the right thing based on the above details. Now, my questions are the following:

  • Will my VISA expire on the same day my WP will be cancelled? Should I still need to go to Labour to inform them? If I would go to the Immigration on 30th of April 2009 for the cancellation do I need to pay for any overstay given my WP was not extended?
  • How long will be period do the Immigration grant to stay in Thailand after cancellation?

Any information from you guys would be very much appreciated… :o

Do you have an extension of stay or are you on a multiple entry visa?

The report you mention is for staying over 90 days that would indicate that your are on an extension of stay and not a visa entry.

You do not have to anything at the labor department that is your employers resposibility.

When your job ends your extension of stay ends and you must leave the country or get a 7 day extension at immigration.

If on a visa entry it does not end.

Thanks for the quick reply. Well i don't have a multiple entry visa. They also mentioned that there's 2 way in cancellation the employers side and the employee side. For the employer they will take care of it and for me (employee) i'll take care of it as well.

I am planning to go this 30th of April to the Immigration for the cancellation informing of my end of employement. Do I have to leave immediately on the same day or do they give me a few more days to do so for May 1, 09 the following day is a holiday (consulates offices might be closed).

You can get a 7 day extension at immigration it will cost 1900 baht. There is no free grace period.

The only thing you have to do is take your termination letter to immigration and apply for the extension.

At one time you had to turn in your work permit at the labor department but that has not been required for over a year. Your efmployer has to notify the labor department. You don't have to do anything there.

The employer is required to deliver a letter to immigration advising of the termination of employment. No notification is required to labor.

Wrong it is the employee's responsibility to cancel the extension of stay.

After reading the above again it states that no notification is needed to labor so I was incorrect on that.
