Hello everyone.

just returned from the land of smiles today..back to grey old england...Anyway my question is this... we have applied for a settlement visa for my wifes 8 year old daughter we applied on the 8th april and was told the visa can now take up to 3 months...so i want to know if when and if the visa is approved will i be able to go pick her up and bring her back to england (will i legally be able to dring her out of the country) if she has to have a interveiw her grandma will be able to take her. the other thing i want to know is once the visa is aproved how long will she have to travel...we have just spent 5 grand on this trip so we cant go on a moments notice....thanks

Is your wife in the UK ? Just wondering why you did not come back as a Family

I doubt very much she will have to go for interview at 8 years Old

Interview would be with her mother if Required

I do belive you are suposed to leave within 28 days from date Visa issued.

May not be possible to get flight so I doubt it would be a problem if it was a bit longer

And Yes it is taking 10 to 12 weeks at the moment

yes my wife is in the uk we all came back together me my wife and 9 month old son we couldnt bring the 8 year old girl back as we didnt have the visa...if my wife has to have a interveiw on behalf of her daughter then she will have to go back to thailand but she is 10 weeks pregnant now so that might be a problem....some one as told me you have 3 months to travel from the date of isuue (dont know if that is right) so if it take 10/12 weeks to get then you have 3 months to travel after issue then that gives a pretty wide time span.....

Yes you may i collected my wifes daughter no problems valid visa for travel is all that is required.

thanks bud the only worry i have now is if the visa is approved how long before i have to go collect her (dont get me wrong i would go tomorrow but its all about money) i have a young family so cant just throw money at the situation. my mate is going thru the same process and his wife as stayed another month to wait for her childrens visa so could we make arrangments for our daughter to come to england with my friends wife (they all know each other)

Yes she could travel with your friends just ensure you are at immigration to collect her. I have also witnessed Emirates looking after children travelling alone.

To qualify for ILR one will need to have been resident in the UK for 24 months; the visa will be valid for 27 months. So, yes, one effectively has 3 months from the date of issue in which to travel to the UK.

However, as your step-daughter is applying to join her mother then her visa will be tied to your wife's. It will expire and she can apply for ILR at the same time as her mother.

Kitty my wife's daughter entered with a visa to match her mothers expiry date if that helps .

My wifes 2 year spouse visa is up on Dec 2oth so we either do the test and do the IRL visa or do a extra 2 year spouse visa. surely they wont give the little girl a 6 month visa or will they and does her visa have to be renewed along with her mothers ?

When a minor child is applying to join a parent in the UK then the visa will be tied to theirs. If the parent does not have ILR then the child will be given a settlement visa that expires when the parent's visa/FLR does so that they can apply for ILR together. If the parent hasn't qualified for ILR when their current LTE expires , for example not satisfied the KOL requirement, then both parent and child apply for FLR.

If the parent already has ILR when the child applies then the child will be given ILE, which is the same as ILR except it's granted outside the UK, not in.

Minors do not have to satisfy the KOL requirement before getting ILR or ILE.
