My wife and I are returning to the U.S. next month and we just found out that she is pregnant. My quesion is, if the baby is born in Thailand can we claim U.S. citizenship, I am a U.S. citizen and my wife is Thai, or will it have dual citizenship? What kind of paperwork do we have to fill out, thanks for any information.

If you are married the baby will have US and Thai nationality. Both countries allow for dual nationality. It doesn't matter where the baby is brn, only that one of the parents is Thai for the child to have Thai nationality.

If the child is born in the US, register the birth in the US and also register the birth with the Thai embassy or consulate.

Thanks for that. Is there a time limit on when you have to do it? I work overseas but I will get emergency leave and hopefully will there in time for the birth. There is a chance, though, I might be a few days late.

when the child is born in the US it will get a US birth certificate.

With that in hand, you can apply (via post I think) for Thai birth certificate from the Thai embassy in Washington DC. The BC will be the most important document, as it will be proof that the child is Thai.

The Thai passport requires attendance at a embassy or consulate which are equipped to issue the passport, so if you aren't near one, or don't intending on travelling to a country where a Thai passport is useful (Thailand, Vietnam, Russia!!) then the passport can wait....

If you ever move back to Thailand, then the child will need the Thai passport to enter and remain indefinetly, and which will then further allow the child to go on his mothers house registry...

The following is if the child is born in the US.

The US side will be easy and straight forward because it will be handled like any birth. The hospital will handle everything including an application for the babies Social Security number. Then it will just be normal process of getting a copy of the birth certificate from whichever goverment office (city, county, state) handles that in the state you are in.

After that it will be the normal process for a passport.

For the Thai side it will just be a matter of going to one of the Thai consulates or the embassy and registering the birth and getting a Thai birth certificate and passport.

You can find info on the website but the information for birth registration and passports is in Thai so you might have your wife take a look. The consulates have websites also,

I don't beleive that there is any time limits for the Thai side. The US side is pretty much automatic.

For here is it is explained on the link given earlier for the US embassy birth registration.

For the Thai birth registration it needs to done in 15 days (or pay 1000 baht fine) and you should be here to be the one that makes the application for the birth registration or their could be problems later.
