I am 27 years old, and an Australian citizen. I am currently on a one year work-holiday visa (non-immigrant B-A) which will expire in October. The reason I got this visa was because there was no option for a spousal visa in Thailand. My partner is also an Australian citizen (neither of us are Thai) who is here for work.

I have heard from many friends (who are also in defacto relationships) that it is possible to get a spousal visa - however they have no idea how to get one as their partners' employers have obtained it for them. I have asked my partners' company to help, but they have a useless HR department.

Is there anyway I can get a spousal visa? e.g. sign an affidavit saying that our relationship is recognised as marriage under Australian law or something like that?

What you call a spouse visa, is a non-immigrant O visa based on marriage to a Thai.

There is also the possibility of being a dependent of someone who is working or retring in thailand, but for this you will have to be married. i sense that is not the case in your situation. That means that you both will have to get your own visa and extension of stay.

Are you saying these people obtain one year extensions of stay or that they were able to obtain one year non immigrant visas that required them to exit/return every 90 days? The extension of stay is very clear that marriage is required. For a non immigrant visa the conditions may be more flexable - in OZ at Perth or Brisbane they are issued to visit friends.

if your spouse in under extension of stay for bisuness reason, you can can get extension for you based on her work.

Yes they are not married. A Non Imm O Visa Multi Entry from Perth or Brisbane is the best option as things stand.

i have a thai wife,i get my one year visa.every three months, someone will call my wife to remind me to extend my visa.

i give him the doc. and 500bth and later on he wil bring my passport with an official receive attach.

is easy and simple.

That sounds like it could backfire at sometime

Can you explain exactly what you mean please. Are you talking about the 90 days report? Are you talking about a Non Imm O Multi Entry Visa? Are you talking about a 12 month extension from Immigration?

I think you are talking about extension of stay not a Visa. You appear to be giving someone 500 Baht to do your 90 day address report on your behalf. If you are happy with that I cannot see a problem. You can do it yourself or do it by post if you wanted.

Yes it is a 12 month extension. Not a Visa.

To be honest, I wouldn't say no to that option.

This thread is about someone who does not have a legal partner - so obtaining a marriage extension of stay is not an available option for them. In your case you seem to be having someone do your 90 day reports rather than doing yourself or mailing them in. And paying 500 baht for the service. And you appear to be on a one year extension of stay which you and wife have to renew each year.

No, we are not married, but we are in a defacto relationship. What reasons do they accept to grant extensions of stay - is being a dependent good enough?

Also, where do I go to request the extension? I am assuming it is at the department of immigration?

To be considered a dependend there must be a family relationship, in your case a legal marriage is required. Living together for a long time is not enough.

An extension you get from an immigration office, there are several througout the country.
