A serious subject...

4 years ago in Perth Western Australia I separated from my wife of 19 years.

After a few months I had a lucky break and landed a job here in Thailand.

3 years ago we underwent financial settlement in the Family Court.

2 years ago we were finally divorced.

Now she's done a title search and discovered I own an investment property back in Oz, and she's back for more money.

Can anyone recommend a good lawyer here in Thailand that is familiar with Australian Family Court proceedings?

The only decent Thai lawyer I'm acquianted with is ' Chuan Leekpai '.

Not sure if you've heard of him  :o

No I haven't heard of him.

Where is he based?

Do you think he'd be able to handle my case?

He'd be none to savvy on the machinations of the Family Court of Australia I'd reckon :o

I wouldn't worry too much - especially if she's taking you to court here.

Can she prove to a court that you have these assets ? Aren't they in Oz ?

Thai courts don't go too big on getting access up your bank accounts etc

If she's taking you to court in Oz - worry...

After 1 year since divorce she can have no claim on you financially, unless you were hiding some assets during the financial settlement..

You can just tell her to get stuffed, I believe.

No hidden assets... full disclosure.

But I'll still need legal representation at the hearing to tell her to get stuffed.

refinance the investment ......... before she put a caveat on it ..make the cash disappear if you feel you are going to lose ...

Too late... she's already had her lawyer obtain an injunction restraining me from "disposing of, charging or encumbering in any way" the property.

I need a lawyer.

Very simple - you need a good lawyer in Perth specialising in Family Law. Contact the WA Law Society (they will have a website) and get a list of practitioners specialising in family law. Then talk to a couple of them to get a feel for what will be required and what the cost will be. It will cost money - but it's better than not being represented.

If you had the property at the time of divorce you are in the wrong and will be screwed. But you say full disclosure, so presume you did not have the property then. But did you buy it later with assets that were hidden?

Otherwise she cannot lay claim to it unless she is looking after your kids, in which case best to settle with her out of court agreeing to deed assets to your children (if she will go for it) now or at their coming of age.

But really, if you want the advice of internet forum muppets like us :o you are best posting on an Aussie forum! Very much doubt that anyone here can be of much help.

Get back to here and see a lawyer here....I work in the criminal law area (not a lawyer)...so cant help with the lawyer side of things...

Be prepared for an extended stay to sort it out.

my understanding is that if you held the title before the divorce proceedings were finalized....your knee deep in it

if you purchased the title with undeclared assets....you are neck deep in it.

Either way, A Thai lawyer will be of little assistance to you. You can try to contact the Law Society here to find a reasonable lawyer...should be able to do that on the net.

A reputable and high-powered law firm in Bangkok is Tilleke & Gibbins. I engaged them to settle a land dispute in Thailand and was very pleased with their professionalism and expertise. Not that they'd be able to help you in Australia but they could definitely point you in the right direction for someone who could. If you're plan is to engage a firm locally, this might be a starting point.

I have now made contact with a solicitor in Perth who specialises in family law and is prepared to take on my case. He is also fairly positive about it so I can sleep at nights again. :o

Thanks also to the admin and mods of this forum for allowing this subject to continue, depite it being non Thailand related.

I hope you have better luck in Australia than I had in the US. I had a similar situation. She was a common law wife. I never married her but she managed to get us legally married. The gave her half of my assets. and she sued me for more. Every time I would go back to go to court they would cancel the court date. I knew what they were doing but could do nothing about it. The first time I wasn't there they went ahead and it was no problem. They gave her the other half! :o

She will die a lonely miserable rich old bitch but here I am living well and very happy. :D
