After a few months I had a lucky break and landed a job here in Thailand. 3 years ago we underwent financial settlement in the Family Court. 2 years ago we were finally divorced. Now she's done a title search and discovered I own an investment property back in Oz, and she's back for more money. Thai courts don't go too big on getting access up your bank accounts etc If she's taking you to court in Oz - worry... After 1 year since divorce she can have no claim on you financially, unless you were hiding some assets during the financial settlement.. You can just tell her to get stuffed, I believe. Too late... she's already had her lawyer obtain an injunction restraining me from "disposing of, charging or encumbering in any way" the property. I need a lawyer. Contact the WA Law Society (they will have a website) and get a list of practitioners specialising in family law. Then talk to a couple of them to get a feel for what will be required and what the cost will be. It will cost money - but it's better than not being represented. But you say full disclosure, so presume you did not have the property then. But did you buy it later with assets that were hidden? Otherwise she cannot lay claim to it unless she is looking after your kids, in which case best to settle with her out of court agreeing to deed assets to your children (if she will go for it) now or at their coming of age. But really, if you want the advice of internet forum muppets like us you are best posting on an Aussie forum! Very much doubt that anyone here can be of much help. Be prepared for an extended stay to sort it out. my understanding is that if you held the title before the divorce proceedings were finalized....your knee deep in it if you purchased the title with undeclared assets....you are neck deep in it. Either way, A Thai lawyer will be of little assistance to you. You can try to contact the Law Society here to find a reasonable lawyer...should be able to do that on the net. Gary A Posted March 4, 2005 Share Posted March 4, 2005 I hope you have better luck in Australia than I had in the US. I had a similar situation. She was a common law wife. I never married her but she managed to get us legally married. The gave her half of my assets. and she sued me for more. Every time I would go back to go to court they would cancel the court date. I knew what they were doing but could do nothing about it. The first time I wasn't there they went ahead and it was no problem. They gave her the other half!
