Hi All,

Just reading up on the rules for ILR from the home office, and noticed that it states a parent of a British Citizen or someone who is settled here is exempt from KOL requirement.

My wife has been in the UK now for 12 months on settlement visa and we had our first child 7 months ago, who is registered as a british citizen.

Does my wife being the parent exempt her, I dont really understand it and would appreciate any help you could give.

I agree that the wording in the link you provide might be made a little clearer, because it appears to add on the reference to Para 317 in brackets as an afterthought, but the exemption is only for elderly dependant relatives. So unless your missis is over 65, and achieved the considerable feat at that age of dropping a sprog who is now earning sufficient to support her, I doubt this exemption will apply to her. It does say in any case that the requirement would still apply to a subsequent application for British Citizenship.

To be fair, it does say "a parent, grandparent or other dependent relative........." (my emphasis), although including the word 'elderly' would help avoid confusion.

There is a clear link to the definition of those exempt under this category.
