BANGKOK (TNA) -- Pojaman Na Pombejra, ex-wife of Thailand's ousted prime minister Thaksin Shinawatra and their children will appeal the assets seizure case decisions separately by March 26, according to her lawyer, Somporn Pongsuwan.

Mr Somporn said that he was drafting the appeal request, which will be separated from the portion of Mr Thaksin himself, while Kitthiporn Arunrat, a lawyer representing their children Panthongtae and Pinthongta said their 20-30 pages of appeal documents for both of them will filed separately within the March 26 deadline.

The lawyers declined to disclose further details before submitting request to the court.

Charttip Tanthaprasart, a lawyer for Mr Thaksin, said Mr. Thaksin’s 100-page appeal document will also be submitted within March 26.

The Supreme Court Criminal Division for Holders of Political Positions on February 26 ruled to seize assets valued at Bt46 billion (US$1.4 billion) from former prime minister Thaksin Shinawatra and his family.

The court ruled that Mr Thaksin's fortune in the form of share dividends and portion of the sale of his family telecommunications company Shin Corp worth Bt46.373 billion is to be confiscated by the state treasury as they were accumulated as ill-gotten gains.

The remaining frozen assets worth Bt30.2 billion will be returned to Mr Thaksin and his ex-wife Pojaman na Pombejra for the sake of fairness as the assets had been acquired before Mr Thaksin became prime minister in 2001.

Decisions by Thailand’s Supreme Court are final under the letter of the law, but under court procedures here defence attorneys may present new evidence relating to the case within 30 days. (TNA)

I thought an appeal had to be made in person to be legal?

First of all I thought no appeals were allowed after the Supreme Court ruling, also I guess we are supposed to believe they earn all that money legally without any insider information. Thirdly, I guess they want all the money so they can pay for fighting the government in the coming year, 100,000x500bth=50,000,000 a day :) . Is kind a expensive venture.

Ah, found it:

Under the present Constitution, the former prime minister may submit an appeal to the Court within 30 days after the verdict if he has obtained new evidence which could lead to the significant altering of the facts of the case. Then, the general meeting of the Supreme Court will elect five judges, other than those serving in the original case, to sit on the panel to consider such an appeal. The implementation of the court's decision will have to await the appeal process.

Why can an ex-wife who is no longer connected (legally) to person A file a case in the name of person A? Shouldn't person A file in person, maybe after service a pending sentence??

And the bullsh1t continues, sounds like the never ending story.

I would like to see the Gov't grant a fractional amount to Thaksin under the small proviso that he claims the money IN PERSON.

If my math is correct, the total funds, around 76 billion baht could be fractionally offered every day, for 120 days in the amount of 633 million baht a day. The total amount that he could ever claim would not exceed the per diem offering, 633 million baht.

At the end of each day the money is unclaimed it goes to the government. If he does claim the money, the remaining balance from then on goes to the hard working rural poor.

So, the sooner he claims the money, and consequently goes to prison, the larger the remaining balance that is given to the rural poor. The more he procrastinates, hence the smaller the remaining balance to the poor. If he waits too long no money is given to the poor.

He must then wait the full two years to spend the funds which would be kept in my bank account for "safe keeping." :)

But then again, its not about he money is it, Khun Thaksin? Your contention all along is that its about the people.

This accomplishes many things:

1.) It gives him some time to think about the offer

3.) It gives the media some eyeball fodder, and provides the rest of us with 120 days of much needed fun.

4.) Finally we can put to rest the argument of how much he loves the underprivileged.

5.) How much does really love the rural folks?

6.) Ultimately, either way, the country of thailand will get the bulk of his money

7.) It will actually stimulate the economy. How? Im glad you asked. Think of all the betting pools that will be happening. This place will make Atlantic City and Las Vegas look like a back-alley card game. How does it benefit the LOS? The Government could then set up gov't subsidized betting pools on every soi and take a small cut, say, 5%.

The question could then be posed to him: Is it all worth the two years in a Thai jail?

Strange how the rabid critic of an undemocratic society is able to continue the scramble for the pot of gold claimed as honestly earned money in this undemocratic society. Perhaps democracy is the case here and now unlike the proposed alternative.

I really doubt Thaksin is one who concerns himself with petty "legalities"....

After defaming the courts for being unfair on verdicts they don't like, they still use this legal facility when it suits them.

So the decision is final, but not final final final, a bit like the day of reckoning demonstrations.

Thailand must be the HUB of final decisions.

The Shinawatras are appealing? About as appealing as being slapped in the face with a wet fish.

Correct and the criteria is that it must be new evidence that wasn't already presented in the years-long trial involving thousands of documents and hundreds of witnesses.

Under that criteria, Thaksin's 100-pages will be blank.

Besides, here's he's likely just going through the motions to file an appeal as he took so much flak for failing to appeal his earlier prison-inducing conviction and that misjudged and indefensible goof made him look as guilty as the court said he was.

thats funny, most lawyers never represent anyone who flees the country, even for petty crimes. these slippery snakes aren't even present and they can be given back 30 billion to "be fair?" since when was this couple ever fair? the judges should just keep it for their next crimes...which are 99.999 % probable.

Outrageous. It says Thaksin earned the 30 billion before. How the hel_l did he do that legally? And what the f-k has any relative, exwife, child, uncle, grandother or whoever right to claim that this money is theirs???? The legal system is a complete fars, it seems. Surprise?

And how can a fugitive from justice have the right to appeal a court decision? And not do it in person?

The accounts that have been frozen are not in Thaksin’s name, they are in the name of his ex-wife and children. I suspect the “new evidence” will be a further attempt to show the money is theirs and not under his control and should therefore be unfrozen and returned in full.
