I met a guy at the Thai embassy in a nearby country who was trying to get a visa to enter Thailand. He had a visa (now expired) in his passport, but the last entry stamp had "cancelled" stamped over it. He was refused a new tourist visa and was told that he had been "blacklisted" for entry into Thailand. Aparently, he had overstayed on an earlier tourist visa, and left without paying the overstay fine (he borrowed money for the air ticket, but did not have enough for the fine). I am sure he will pay the unpaid overstay fine and any penalty to resolve this situation as he has a family in Thailand. Can he appeal the blacklisting? If so, how and to whom (I assume the appeal is to the Department of Immigration). Any help will be appreciated.

Mmmm sounds strange. How can someone leave by air, go trough immigration and not HAVING to pay???

Never heard of that.

Maybe there was/is another reason for the blacklisting.

From my understanding, he would not have been able to cross any border land/sea/air without first paying the overstay fee. I would venture to say there is another reason that he has been blacklisted.

Just for sh..s and giggles, did you ask you for help/money?

I have taken what he told me at face value. He said that he spent 4 days in jail until his friends came up with the airfare. I guess that the Thai immigration wouldn't hold him longer for overstay if he can leave, but they won't let him back. The issue is the process to appeal blacklisting. The reason for the blacklisting will determine in large part whether the appeal will succeed (and perhaps whether he sould pursue the appeal in the first place). But that is a question he will need to answer. I am just trying to tell him how to do it.

The reason for your friends’ problem is that he broke the Thai law; the Immigration might think it could happen again. Reading between the lines, there could be some important parts missing as well.

Being imprisoned in Thailand before doesn’t make you to a welcome guest for an understandable reason.

He can try again in 5 years, basically he's screwed, exactly screwed as all deportees are. Last summer (August) I spoke with a consult official in Canada about their biometric programs. He stress in regards to passport issuances and foreign visas that they were stepping up their review system to weed out undesirables.

I agree that his problem is likely the nonpayment of the overstay fine. the B20K is the maximum fine, and is not necessarily what he owed (or owes). And while he did spend some time in jail for the offense, it does seem that in the scheme of things (assuming that something more serious is not involved) paying the fine and perhaps a penalty would be seen as adequate restitution. And they may well be fearful that he will repeat is offense. How many farang over stay their visa, pay a fine and get another visa no questions asked? Maybe he is SOL for 5 years, but an appeal of his present status should be allowed. And perhaps he should have made an inquiry as to his status before applying for a visa. But not everyone is as smart a Samuian -- too bad for that! Regardless, the guy deserves a chance to make his case before the proper Thai authorities. I guess I need to go to the Thai Dept of Immigration, rather than read more of this worthless dribble. Better to criticize a poor farang (or speculate on his "real" crime), rather than offer any useful help/suggestions.

- your "buddy" made it!

As I wrote there are other way's, just think - I won't suggest them here, as it really doesnt take much!

No one is "whining", just annoyed at the unhelpful responses (incuding your's). And how pray tell does one take "the first step" (regardless of what it is) from outside Thailand. Several options might exist if he were actually here, in Thailand. Go back and dance the Mamushka, you're better at that no doubt.
