Karom also said the group's legal team will file a petition with chief judge of the Criminal Court, Boon Thapanadul, asking for a change of the judge responsible for the case against the red-shirt elements.

He said the present judge presiding over the case has not given the accused a chance to counter their allegations and failed to run the trial in a transparent manner as he has turned down the group's request for permission to sit in the hearings.

We will struggle on till we find a judge who likes us :huh:

Red-shirt leaders to lodge petition to Criminal Court chief against 'unfair' hearing

The lawyer of the red shirt leaders announced Tuesday that he would not sue for malfeasance the judges hearing the case against them, but instead would seek justice from their supervisors.

Karom Ponthaklang said that his about-face came after consulting with other members of the red shirts' lawyers and legal advisers and the 19 red shirt leaders charged with terrorism and inciting unrest in connection with the turmoil and riots that followed 10 weeks of an anti-government rally last year.

He said it was agreed that an open letter would be sent to Criminal Court's chief judge Boon Thapanadun and the Judicial Commission, in their capacity as the judges' supervisors.

Karom said the complaint came after the defence "felt that the court did not allow them sufficient opportunity to fight in the case".

The red-shirt group has pressed a malfeasance charge against the judge in charge of their terrorism case, claiming a lack of transparency in the trial.

Red-shirt lawyer Karom Polthaklang this morning visited the group's core leader Nutthawut Saikua at the Bangkok Remand Prison to have the latter sign a complaint against the judge presiding over the trial on the terrorism charges against him and his associates.

The petition accused the presiding judge of malfeasance for failing to provide the defendants with a full opportunity to clear their names and rejecting the group's request for permission to attend hearings as well as to change the trial room to a bigger one to accommodate all the defendants' relatives who want to witness the trial.

The lawyer insisted the move was not a tactic to delay the court proceeding of the terrorism case against his clients and he did not anticipate the current presiding judge to be replaced.

Karom, however, suggested the law requires a judge who has a legal dispute with defendants in the case he oversees to be removed from the trial.

The complaint was lodged with the Criminal Court this afternoon.

No tactics, no tricks to get a trial delayed, but pure and plain justice. Till all judges have been found prejudiced or found in legal dispute with defendants. Of course a different group will complain that the 'terrorist trial' is not materialising due to government interference and suppressing the basic rights of the defendants. This game may take a while to finish ;)

Yes, we're still waiting on their trial over their July 2007 riot, as well as their Black Songkran 2009 charges... so yes, it might take more than awhile.

Lawyer for red shirt leaders makes about-face

The attorney for the detained red-shirt leaders said yesterday that he would not sue for malfeasance the judges hearing the case but instead would seek justice from their superiors and the court system.

Karom Ponthaklang said his about-face came after consulting with other members of the defence team and legal advisers and the 19 red-shirt leaders.

They agreed that an open letter would be sent to Criminal Court chief judge Boon Thapanadun and the Judicial Commission to look into "unfair" treatment from the judges.

The defence "felt that the court did not allow them sufficient opportunity to fight in the case", he said. The 19 red-shirt leaders have been charged with terrorism and inciting unrest in connection with the turmoil and riots that followed 10 weeks of an anti-government rallies last year.

However, Karom said legal action against the judges remained an option if the appeal to the judges' supervisors did not work.

"We will wait and see if there will be any improvement. If no action is taken, the defence's lawyers will have to come up with a new way to fight. But I can't tell you now if we will have to sue the judges," the lawyer said.

In the morning, Karom visited red-shirt leader Nattawut Saikua at Bangkok Remand Prison to ask him to sign a legal complaint to be lodged against the judges, but Karom changed his mind in the afternoon.

It will be interesting to see what evidence will be used to charge 11 people on terrorism.

Security and forces also had undercover agents within the protesters so I am sure they found something to back up these charges.

But as with the autopsy results nobody really knows what they have!

Thida, whose husband Weng Tojirakarn is in remand cell, said the letter would make the judges aware of the legal predicament faced by the red shirts.

"The open letter will outline grievances in connection with the legal proceedings, including the arrest, the charge for terrorism and the denial of bail applications," she said.

According to the other paper, there will be Red Shirt Rally on Sunday, February 13th. They plan to give an ultimatum to Abhisit's government to set the Red Shirt Leaders free. They neglected to say what repercussions there would be if their ultimatum was not met.

The Red Shirts will assemble at the Bangkok Remand Prison, where the Red Shirt Leaders are being held, at 1:00pm and then later on move to Victory Monument.

Lastly, the Red Shirts announced will assemble again, at Ratchaprasong, on Saturday, March 19th.

Wasn't it 2 months ago that the Reds were attacking judges left and right for all sorts of malfeasance's, and now they want judges to be their friends. Seems they are a pretty clueless bunch...

The other paper is reporting this afternoon that a new effort to seek bail for the jailed Red Shirt Leaders will be made on this Monday, the 7th.

Their lawyer will go to the prison on that day for them to sign the request and then deliver it to the Criminal Court later on the same day. They will offer 3 million baht bail for the 7 detained Red Shirt Leaders; the same total of 21 million baht that was offered and subsequently denied earlier.

Renewed attempt for bail of seven red leaders

Red-shirt leader Thida Thowornseth on Wednesday posted Bt4.2 million in cash as bond to seek the temporary release of seven red leaders held in remand for terrorism charges in connection with last year's rallies.

Defence lawyer Narinpong Jinapak said he filed a fresh batch of bail applications for the seven based on a precedent set the release of yellow-shirt leader Chaiwat Sinsuwong who faced similar charges in connection with the seizure of two Bangkok airports in 2008.

In the Chaiwat case, the court set bail at Bt600,000, he said.

The Criminal Court has yet to decide on the bail hearing.

It seems since last time 4 of them no longer matter.

No mention yet of any help for the small fry that are also locked up.

And wasnt it 19 mill last time where has the rest gone?

Bail hearing for seven red leaders on Feb 21

The Criminal Court has scheduled February 21 for hearing on bail applications for seven red leaders held in remand on terrorism charges in connection with the last year's riots.

Defence lawyer Narinpong Jinapak said the defence plans to call a number of witnesses to testify in favour of the temporary release.

The defence witnesses include Kanit Na Nakorn, panel chairman in charge of truth and reconciliation.

The defence has posted Bt4.2 million as bond and sumitted fresh arguments based on a precedent set by the release of yellow shirt leader Chaiwat Sinsuwong.

Court Considers Bail Petitions for 7 Detained Red-shirt Leaders

The Criminal Court has begun a hearing for bail petitions for seven red-shirt leaders, with the Metropolitan Police Region 1 commander being called to give testimony.

The Criminal Court called forward seven core leaders from the red-shirt Democratic Alliance Against Dictatorship, or DAAD, who are currently being held at the Bangkok Remand Prison on terrorism charges, in today's hearing of their bail petitions.

The red-shirt group's caretaker leader Thida Thawornset said Nuttawut Saikua and Veera Musikapong appeared before the judge at the morning session.

She claimed that the Commander of the Metropolitan Police Region 1 Police Major General Wichai Sangprapai will also give testimony to confirm that the red-shirt protesters were conducting their activities within the scope of the law.

Thida added that the commander of the Bangkok Remand Prison will give testimony on the actions of the seven core red-shirt leaders while they were in detention.

She expects the court will issue the temporary release of the seven red-shirt detainees and insisted that the red-shirt leaders are not terrorists.

She said that the evidence presented by the Department of Special Investigation, or DSI, is insignificant.

Meanwhile, DSI Director-General Tharit Pengdit revealed that his agency will file a petition against bail applications, and pointed out that the red-shirt leaders have been accused of serious charges and warned that they could incite further chaos if freed.

However, he said the agency will not petition the bail amount for Weng Tochirakarn and Korkaew Pikulthong.

Kanit, Sanan testifies in favour of red shirts' requested bail

Kanit na Nakhon, the chairman a special government panel, and Deputy Prime Minister Sanan Kachornprasat Monday testified in favour or the seven red-shirt leaders' bail applications.

Kanit, former attorney-general and chairman of the May 19 fact finding panel, has earlier recommended the temporary release of the red-shirt leaders for the sake of national reconciliation.

Earlier, Korbsak Sabhavasu, former PM's secretary-general, testified in favour of Veera Musigapong's bail application, and thus convincing the court to release him on bail.

The court has yet to make a ruling whether to approve the applications.

Based on his countless other lies, eg. saying from stage of the smallish Red Shirt gathering on Saturday that it was the "the biggest rally ever", I'm not putting too much faith in his vow to exchange places with his incarcerated brethren....

As if that was even ever an option in the first place.

Legal proceedings are not subject to his childish games, like "If you go get ice cream, I'll hold your place in line"...

The Criminal Court on Tuesday approved the bail of seven red leaders on the conditions that they will not get involved in any disturbances and comply with a ban against travelling abroad.

The seven, including Natthawut Saikua, weng Tojirakarn and Kokaew Pikulthong, each put Bt600,000 as guarantee for the temporary release. The bail approval followed the Monday's hearing.
