Jatuporn: Thaksin lawyer plans to petition International Court of Justice

BANGKOK: -- Anti-government Red Shirt key leader Jatuporn Prompan revealed on Friday that fugitive ex-premier Thaksin Shinawatra's American lawyer Robert Amsterdam plans to petition the International Court of Justice (ICJ) to pressure the Thai government to release to him its documents on the violent clashes with the Red Shirt protesters.

Mr Jatuporn commented after Mr Amsterdam said he had written a letter to senior Thai government officials asking that Thailand empanel an independent agency to investigate the army's actions against the anti-government protesters which he said led to higher casualties and that the government must reveal evidence of the cases.

The deputy prime minister Suthep Thaugsuban immediately rejected Mr Amsterdam's request, saying the lawyer is only an employee of the deposed premier and has no legal standing in Thailand to order the Thai government help him.

Ninety people were killed and nearly 1,900 were wounded in clashes between troops and the Red Shirt supporters during their ten-week campaign against the government.

Mr Jatuporn accused the government of trying to hide the truth and Mr Amsterdam's law firm is preparing to use international legal rights to seek the ICJ's prestige to force the Thai government to disclose the details of the cases.

The Red Shirt leader also warned that the refusal of the Thai government will cause trouble for the country.

Meanwhile, Prime Minister Abhisit Vejjajiva said it depends on the Centre for the Resolution of Emergency Situation (CRES) to consider Mr Amsterdam's request.

The premier emphasised that Mr Robert is an employee and has clear objectives in working for the ousted ex-premier.

"He (Amsterdam) previously came to Thailand and chose to take [only a part] of the information into consideration and told foreign countries that there were no armed protesters at all," said the premier. "This makes us think that even we send him the data, it will also be distorted."

Mr Abhisit asserted Mr Amsterdam is attempting to interfere in the Thai judicial process as he has been paid to do this, adding that many agencies with international experts are now probing the incidents.

Regarding the planned visit to Europe of Mr Thaksin's legal adviser Noppadon Pattama, the prime minister said the employee must do his duty but the government must give correct information to foreign countries, citing the resolution of the Congress as showing a good understanding of the Thai political situation.

When asked what measures the government will take against Mr Amsterdam if his moves damage Thailand's image, Mr Abhisit said it depends what level of offense he has made and whether Thailand should give importance to this kind of person.

Mr Abhisit said Mr Amsterdam has used various approaches in fighting many cases and has a lot of highly paid networks. It is a matter for the concerned Thai officials to consider whether the foreign lawyer will be allowed to enter [and practice law] in the kingdom.

In related development, the Lawyers Council of Thailand (LCT) on Friday issued a statement condemning Mr Amsterdam’s move, saying he should try to learn more about the Thai judicial process if he represents the deposed premier and other accused Red Shirts on terrorism charges.

The LCT statement said Mr Amsterdam has done more than the normal practice of lawyers, adding that the Thai judicial process and investigation meets international standards.

Mr Amsterdam has no right to seek special treatment or investigation for his client, said the statement, adding that the Thai government's agencies need not respond to the Thaksin lawyer's request.

The Lawyers’ Council also called on the Thai foreign ministry not to ignore such moves and to monitor the actions to distort information about the Thai judicial process and to scrutinise Mr Amsterdam’s website.

If the information in the website is distorted and supports terrorism or attacks the kingdom's judicial process, the statement said, legal action should be taken against the ex-premier's lawyer. (MCOT online news)

Why would the legal government of Thailand give information to a terroist who refuses to come to Thailand and has taken out citizenship in another country.

Truly the man's ego is matched only by his stupitidy. I am sure he is a layers dream come true unlimited funds. And if the Layer has any thing on the ball or is awake for thar matter he knows it is a lost cause.

Given that there are a lot of evidence against Thaksin and his gang by paying all these Red Shirt and also tell them to destroy and kill Thai official, he would have a chance in hel_l to get anywhere in the International court. I would think will be embarrassing and at the end will go against him.

His democracy movement is all about garbing the power he had and he greatly abused

But again the Lawyer will win anyways

If you look at the wider picture, you will see this is a smart move. The government is doing al it can to censor information and restrict freedom of speech within the country but it cannot do that outside the country. The proposed action is intended to keep the the international media's attention on the situation in the Kingdom. Furthermore, it is an action to which the Thai government must respond.

Ultimately, the action may not succeed, but that is not the point. The point is that the protests have moved from the streets of Bangkok to the international arena.

The International arena has as much importance as you attach to it. Ignore it and it means nothing. Realistically, does anyone in the media ever cover something not controversial. Remove the controversy and all attention is diverted elsewhere.

A private citizen of Montenegro has no standing to demand anything from the Thai Government. I doubt the world court would entertain a a politically motivated private action from a fugitive who has also been charged with Terrorism. Absurd, so simply ignore it. To even defend against it lends credibility.

Thaksin is a fugitive with a conviction hanging around his neck which will be carried out - if he ever returns to Thailand; he is certainly not in any position to demand anything from the Thai government.<BR><BR>Whilst there may be others who do have a claim for release of information, even (sadly) Jatuporn himself, given that he is a part of the political arena, Thaksin has no right to anything.<BR>

It's a dumb move, the americans have backed the Thai goverment, the Europeans will also back them.

So Thai goverment 99 : convicted criminal Thaksin 0

but as long as he has money, there are many people who will gladly help him to spend it and help to keep his name in the papers.

With the lobbying groups and lawyer hired by K. Thaksin, the government feels the need to counter at least a bit. I can understand that. Luckily they don't spent billions, but any money spent could have been used for more useful things. As a tax-payer I'm saddened.

Thaksin seems to try to be in some headline on a 2 or 3 day cycle. Maybe he is building a scrapbook for the library he envisions being built for his followers/subjects. Ignore the little man, as he proving to be.

Amsterdam knows Thaksin is desperate and in dire straights and like any good lawyer he is prepared to take full advantage of it and milk him out of a few more million all the while pretending to use his non existent "high level" contacts.

Interesting to note that that the U.S. House of Representatives voted: 411-4: to support P.M. Abhisits 5 point national reconciliation programme on Thursday July 2 nd.

Might not that vote tell Thaksin he is the prime candidate for village idiot along with the fact that Robert Amsterdam is happily shafting Thaksin for all he is worth, a delightful pair of corrupt fraudsters who so rightly deserve each other.

What if this loving caring man was to give all this money(money has has been wasting on lawyers, etc) to the poor or charity in Thailand , then there will be no more poor.

He is probably more decent then many Thai lawyers. Thai lawyers not only will take your money but will also make a deal with the opposite side to loose and get paid from both sides

Calling him a lawyer is being nice, PR flack is more like it.

The ICJ doesn't hear cases like this, it solely cases of dispute BETWEEN nations,

not between INDIVIDUALS and nations.

So this is more B.S. for it's PR value to the uninformed or gullible.

The government will NOT be quaking at the non-existent threat.

And most nations are not so gullible as to be lead by the nose

by a "damned hamster" pulling a string of lies.

Yes take the money from that deperate Kuhn T. and say what ever he thinks

keeps the pot appearing to be stired from the vantage point of 'client Thaksin'.

It's a good profit center for this year with out a doubt.

Remember too this pronouncement is coming from Jatuporn, who tends to talk from

the ass whistle more than most, except for Noppadom. Gotta say Thaksin sure can pick'em.

His coterie is filled with wingnuts, wengers and the wicked. What a wonderful judge of character he is.

And yes to; much more money than common sense.
