Hi all you helpful people,

I've not been on here for some time, and like to thank all those that gave me the best advice about spouse visa.

However I have just one more question.

My wife has now been with me in the UK for nearly two years on a spouse visa.

What is my next step?

Do I apply for ILR or can we Now apply for Citizenship.

I have been led to believe that we can apply for citizenship is this true?

I thank you for any advice you can give me.

My wife is working part time and has an National insurance number.

In answer to your question, she will have come to the end of her settlement Visa. You can apply for Further leave to remain, which is basically a further two year extension, or you can apply for Idefinite leave to remain or Resident permit as it is now known. But for ILR she will be required to either gain a certificate in ESOL course or an easier option is to take the Life in the UK test. 24 questions based on UK History and current affairs. Citizenship can only be applied for once your spouse has spent 3 years in the UK from her settlement date and she must have not spent more than 270 days outside of the UK within a three year period and not more than 90 days in the final year. The three year period can be counted from the Day she first arrived on her settlement Visa.

As said, once her current Leave to Enter/Remain expires she will need to apply for a new one. Either Further Leave to Remain, which will last for 2 years, or Indefinite Leave to Remain, which is indefinite.

To qualify for ILR she will need to demonstrate that she has the required Knowledge of language and life in the UK and show that they two of you have been living together for the required time; see Completing application form SET(M).

If she does not meet the requirements for ILR, she will need to apply for FLR, see Applying as a husband, wife or civil partner from inside the UK.

Once she has ILR and has been in the UK for at least 3 years she can apply for British citizenship, see Requirements for naturalisation if you are married to or the civil partner of a British citizen.

Thanks to the guys that replied, We have decided to go for ILR. as her Knowledge is very good.
