hi everyone im back again, i would appreciate any help on preparing kids settlement visa hopefully to put in new year, im gathering all info i can from this forum but would be very grateful of any info put to me, my wife got her settlement in august 11th 2010, the first boy is 10yr old with usa passport, 2nd child 5yr old with thai passport, i dont think we have a problem with most of paperwork but am not so sure about what we need to show sole custody so if anyone has any info on this part it would be greatly appreciated, plus can anyone see complications because one is us and one is thai???, any info greatly appreciated,

Sole responsibility is the key factor in child to join mother. Your wife must show if she has had custody of her children she would need to show the court paper and also ideally a por kor 14 document which documents a short history of the child upbringing, showing sole responsibilty which means actively controling the childs upringing. School reports, reciepts and documents linking your wife and the children to the same address as your wife previous to her settlement, and also being that your wife has made the major decisions regarding schooling and welfare. It is also important that the children must have lived with the mothers parents and not the fathers. In the case of the children having been cared for by both paternal parents prior to your wife's settlement I am sure an agreement would need to be signed by the father. Obviously in the case of sole custody this would not be relevent. All the answers are in the ECO guidance notes which are available to all only they tend to be buried in the website funnily enough. I am waiting this week for my step son to get his settlement at the second attempt. The first I hasent to add was a poorly put together application showing very little evidence of" sole responsibility"seemingly the key factor. Hopefully we have demonstrated enough this time

thanks jason, yes ive seen you on settlement visa waiting and good luck, and im awaiting your outcome almost as much as you are mate, my wife has had both kids from birth, but has no court papers to show this, the oldests father was in touch for about 3 yrs but now just pays a little money every month but has not seen the kid since he was 5 hes now 10, the youngest ones dad has just never been around since he was born, they dont know they have g/parents on their fathers sides any of them, obviously she can get school papers etc, thanks
