September 7, 201015 yr I found the following in the Teaching in Thailand forum from a post made back in 2003. I had a 14 day overstay on my previous Non B due to lack of funds to pay overstay fines and am now on 7 day extension to let me go and get a new visa. I'm all set to go to Laos and apply for a new Non B. Does anyone know if it is still the case that my application cannot be submitted because of my overstay (see line 2 below in bold text)? I really hope not. I have posted already about my situation and nobody mentioned that having the overstay could be a problem for me. Perhaps this was a previous 2003 law that no longer applies 6 years later. Advice ASAP much appreciated - I will be leaving for Laos tomorrow night (Wednesday 8th). DOCUMENTS TO BE SUBMITTED IN SUPPORT OF THE APPLICATION FOR VISA OR VISA STATUS ALTERATION (NON-B ): WORKING AS A TEACHER IN THAILAND In case of overstaying in Thailand, application could not be submitted. Application for Visa Status Alteration. (TM.86) Application for visa. (TM.87) Copy of passport entries. 4 X 6 cm. Photograph. Application fee of 2,000 baht. To be a teacher in a GOVERNMENT school or university. As a teacher at the University • A letter from the director of university , requesting visa or visa status alteration. As a teacher at the school • A letter from the department concerned under the Ministry of Education or a letter from the governor of province, requesting for visa or visa status alteration. And • Employment certification form (Download the form from Labor Dept. website) • A copy of employment contract. (The start working date shown in employment contract must be the same date with application or after getting approval of visa alteration.) • Diploma and transcript of the applicant. (Must show the original and copy to the officer as proof) To be a teacher in a PRIVATE school or university. As a teacher at the University • A letter from the rector of university, requesting visa or visa status alteration. As a teacher at the school • A letter from the department concerned under the Ministry of Education or in the case of lower academic levels in education, a letter from the governor of province, requesting for visa or visa status alteration. And • Employment certification form (Download the form from Labor Dept. website) • A copy of employment contract. (The start working date shown in employment contract must be the same date with application or after getting approval of visa alteration.) • Diploma and transcript of the applicant. (Must show the original and copy to the officer as proof) • A Certified copy of the registration papers of the educational institution. (Certified by authority signature and institute’s seal or stamp.) • A Certified copy of the license of the school or university administrator(Certified by authority signature and institute’s seal or stamp.)
September 7, 201015 yr It appears to me they were trying to alter the visa status within Thailand, that is not the same as your situation.
September 7, 201015 yr Author This particular situation was a guy applying for his first Non B visa, the poster was asking why he only got 3 months as opposed to 1 year on his Non B. It was not a visa alteration. If you read the header from that section it is "Documents to be provided in support of the application for a visa OR visa status alteration." It was taken from this link, but I see nothing on there about overstay affecting Non B visa applications. http://www.mfa.go.th...482.php?id=2492 Think I should be alright but any further comments welcome.
September 7, 201015 yr Dude, Don't worry about it your overstay will have not effect on you getting your new Non-B visa. I have overstayed(longer than 14 day) went out and got a new NON B, worked the year took SOME TIME off, decided to go back to work and to pay overstay and get a new NON B. It will not be an issue.

Thanks for letting me know ThaiRich - I had hoped that was the case so that's a weight off my mind anyway. Just read about this today after having been stressing about other complications, so was a tad worried ... but I knew someone out there would tell me not to worry about it. Cheers.

As for B visa single entry is normal for first application for most people as you are expected to extend your stay inside Thailand rather than make border runs every 90 days. This is especially true for teachers who are not subject to the higher nationality/salary requirements from Immigration.

Okay well that makes sense if you read between the lines - you can't make the application while on overstay, fair enough. Well, as said I've paid the overstay fines off, so no worries then.
