On the underside of the buttons there is a conductive material. If you press harder the electrical resistance is lower and you have more change that it will work.

2 Why do banks charge a fee on "insufficient funds" when they know there is not enough?

Because when they charge you a fee it is based on how much you are below 0. The fee will make your balance more negative and the next period the bank can ask a higher fee. This will increase the banks profits.
