That girl must not escape justice....no matter what, SHE MUST NOT ESCAPE JUSTICE.

she will though...

I'd say that she has already been punished somewhat. And she probably wouldn't have been had there not been such an uproar. Now let's wait and see if the law punishes her too. I have a feeling it will be little compared to what she already has gotten

There is justice in Thailand after all, one way or another :)

Teen Suspect in Van Crash Granted Temporary Release

The Juvenile Observation and Protection Center has granted a temporary release for the 17 year old woman involved in a fatal van crash that killed nine people after she reported to police.

She has given an apology for the tragic incident.

Investigators escorted the 17 year old driver who accidentally rearended a passenger van on the Don Muang Tollway, causing nine deaths and seven injuries, to the Juvenile Observation and Protection Center on Chaeng Wattana Road after she turned herself in to police at the Metropolitan Police Bureau to acknowledge the charges against her.

She has been charged with fatal reckless driving and driving without a valid driver's license. Investigators spent almost three hours to question the teen.

After the investigation process, the suspect said briefly that she felt sorry and apologized for the accident.

As for the process that the Juvenile Observation and Protection Center will carry out after the suspect was charged, an investigation team will be set up.

The team, which will comprise investigators, probation officers and psychiatrists, will examine her age, mental condition, intelligence, antecedents and cause of committing an offense.

The team will conclude the investigation and submit the report, including proposal on punishment, to the court by 30 days or not exceeding 90 days. The maximum penalty for the crime is seven years in jail.

The Juvenile Observation and Protection Center has no authority to detain the suspect since she is a minor.

Hence, she will be temporarily released without any bail condition since investigators said she was not under arrest.

Meanwhile, deputy commissioner of the Metropolitan Police Bureau, Police Major General Amnuay Nimmano, disclosed that the suspect has given full cooperation to police as well as useful information for the case.

Amnuay dismissed concern over the case, saying there is clear evidence, including the video footage from a surveillance camera at the scene and witnesses' accounts.

He refused to disclose further details, fearing it could effect the case, and assured justice for all sides.

As for the proceeding of a civil suit, he said the suspect's relatives have asked police to mediate negotiations with the families of the crash victims.

Teen Suspect in Van Crash Granted Temporary Release

<snip>

Good decision.

Agree, both the girl and her mother has admitted more guilt than what their lawyer would have recommended them to do. The girl has strong connections here and is not going to go anywhere. Yes, let her go home to her parents, they need each other now

What about the charges involving the deaths? Should be more serious charges than seven years for nine people. How about nine charges.

The maximum penalty for the crime is seven years in jail.

It would be vehicular homicide and 70 years if she were a farang man. Anyone want to bet the drunk German guy in Pattaya gets more jail time for killing one guy this week than she does for killing nine people? Maybe he should quickly change his name to Gunter na Quarz.

It was more manslaughter than homicide.

I would be very surprised if she does any jail time, despite her admission of guilt and remorse, had it been the van driver who caused these deaths, she would have been in jail from the moment she got out of hospital and the hearing would have been whether or not to grant her bail whilst charges are being prepared. In all honestly the girl should be locked up whilst the appropriate charges are prepared. The usual message is being sent out, if your are rich and you have connexions then all will be okay no matter what you do, unless it be LM.

Details... Details... the Devil would be in the details.

If 1 person where to die, it would be a maximum of 7 years.

If 9, it would be 7 multiplied by 9. (7 years multiplied by 9 persons).

I believe it would be 9 charges (I'm not a Thai law expert), not a combined charge.... I don't think there is a 2 for 1 discounts, or end of year sales here.

As reporters are just that, not lawyers, they may "interpret" things "incorrectly".

As lawyers are just that, they will do what ever to protect their clients.

But... as stated as maximum, no one stated the minimum.... so it is possible for the person to get a maximum of 7 years total. 1 year per person, (1 year multiplied by 9 persons).

As lawyers are just that,... well... we all hate them until we need them.

Yes. The girls speeding was probably deliberate. She was reckless, but she didn't intend to cause death.

Criminal law 101 (that's as basic as it gets by the way): Homicide is when you intend to cause death. It's still manslaughter regardless of how much the girl was speeding

Please consider if you have enough knowledge in the area discussed before posting, law does not seem to be one of them

BFD is I incorrectly called it homicide instead of manslaughter. It is really irritating when simple minded people miss the point and are so easily confused by a simple mistake. Get on point or go away.

The important point is:

SHE KILLED 9 PEOPLE. She intentionally violated multiple laws.

A 7 year sentence seems very light in comparison to the magnitude of the crime. The penalty should be times 9 because it should not be pay for one get 8 free.

She said she is "sorry". My response is 'bullsh!t" to the silly idea that if she says sorry, it all goes away. She did the crime, now do the time and pay up big time!

(snipped other quotes)

"What about the charges involving the deaths?"

She was charged with "FATAL reckless driving" which means she was charged for causing the deaths.

She intentionally violated the law - and she has been charged for driving with out a license.

9 people died - and she has been charged with "fatal reckless driving".

The law says that she could get a 7 year sentence. Do you think she should be charged according to the law, or charged according to peoples outrage?

So Whybother, you think she should get a quanity discount?

Simple concept for most people to grasp. It should be 9 multiple counts/charges for the 9 deaths and 5 more charges for causing great bodily harm to the injured people.

Total of 14 charges for each person dead or injured, not just one charge of "FATAL reckless driving".

Seems to be a special deal for Somebody na Important.

I don't know all the circumstances and facts of the case, so I don't know what her punishment should be.

Most legal systems in the world do not at all see punishment to be handed out as simple as "multiply the number of people affected with a base penalty"

Do you come from a country that takes such a simplistic approach?

Some people seem to be missing the point here. The girl has been charged, obviously the Police investigation has revealed some important facts and enough of them for the Police to lay the charges that will soon go before the courts. Its all happened rather quickly IMO, especially considering similar investigations in the west can take months to finalise before charges are laid. One can only hope that nothing has been rushed & the evidence gathered is robust.

Now the solicitors can get involved & there can either be a plea to the charges or a hearing or whatever & then the presiding judge can make a determination from there based on the evidence that can stand up to the vigors of examination in the court.

Bouncing up and down in your seat, getting your jocks in a twist, striking keys, pounding your fist in the air & pumping your chest out is going to acheive little, although I do acknowlege it provide some of you with the exercise you so desperately need. :cheesy::Dave:

This has already gone alot further than it would have, had it been 9 burmese workers or lower still, expat farangs on a mini bus jaunt been wiped out in the same fashion.

My thoughts at this time are with the families and friends of people who lost someone in this aweful incident. I hope justice prevails and that they get some closure in due course.
