Silenced Jatuporn asks court to clarify his status

The lawyer for Jatuporn Promphan, red-shirt leader and MP from the opposition Pheu Thai Party, yesterday filed a petition with the Criminal Court, seeking further explanation of the conditions required for Jatuporn's temporary release.

Lawyer Karom Ponthaklang, who represents Jatuporn and other red-shirt leaders, said the goal was to get clear information as to what Jatuporn could and could not do, particularly in his roles as an MP and a leader of the red shirts, who plan their next rally on Sunday. (Jan 9)

Jatuporn, along with 18 other red-shirt leaders, faces charges of terrorism and inciting unrest in connection with the political upheaval of April and May. Many of the charged red-shirt leaders are now in remand, while Jatuporn has cited immunity from detention due to his MP status.

However, during the parliamentary recess, the Department of Special Investigation (DSI) unsuccessfully sought a court decision not to renew Jatuporn's temporary release, citing his active involvement in red shirts' political activities.

The Criminal Court recently ruled not to cancel Jatuporn's bail. But the court imposed conditions barring him from taking part in political assemblies of more than five people and issued a gag order on him to stop spreading information that could influence his case - except when he debated in Parliament as an MP.

Karom said yesterday the court's conditions affected Jatuporn's constitutional rights and liberties.

"If Jatuporn violates any of the conditions, the DSI may seek court withdrawal of his bail again, and there is a risk his temporary release will be cancelled. So I petitioned the court for explanation," Karom said yesterday, adding that an appeal on the earlier court decision would be submitted within 30 days.

The lawyer said Jatuporn might appear at the red shirts' rally on Sunday but may not address the participants as he had done earlier.

Jatuporn said yesterday many questions were left unanswered following the court order, including the question whether he could join the January 9 rally in memory of the killed protesters. "I am going to join the candle-lighting ceremony in memory of the 91 people killed. I wonder if this will affect the authorities' investigation. Can I take part in a Pheu Thai Party seminar or an academic panel discussion organised by universities?" he said.

He said he wondered which law the court cited when setting the conditions preventing him from attending any gathering of five people and more, now that the emergency decree was lifted.

Deputy Prime Minister Suthep Thaugsuban yesterday rejected a perception of double standards by the courts. He was responding to remarks by the red-shirt movement's chairwoman Thida Thawornseth that the International Court of Justice had been asked to send observers to the court trial against the red shirts.

Democrat spokesman Buranaj Smutharaks said it was improper to seek intervention by foreign organisations into the country's internal affairs.

Since when do bail conditions have to invoke a law? He could be placed under a dusk to dawn curfew, or any other restriction the court feels appropriate. If he finds that he cannot comply with those restrictions, the alternative is always waiting.

What about OUR rights, listening to this thug night after night screaming abuse and vitriol into the staged area of the city? A front man for a convicted criminal and then claiming parliamentary privilege? His 'liberties' should be defined by setting him in a confined space for the next 20 years with speakers blaring in his head about burring Bangkok and inciting riots. Bin Laden in the late 80's was given the same treatment and look what he did!

He is desperate to release his hate speech vomit at the next rally, but is dreading that he'll have to keep it all inside. Maybe he'll have to get someone else to speak for him. The effect just won't be the same though. I always laugh when Jatuporn speaks. Imagine if he became Prime Minister.

Doing so would also violate his bail. It was an additional part of his bail condition that other people are not allowed to read his speeches.

I agree he's desperate. Boiling steam under pressure needs to be constantly released. If not, the pressure builds up until his head explodes.

Even a mother may be hard pressed to claim the figure in this picture. I like the 'truth today' slogan.

His aging mother in publicly admonished him last year.

His restrictions are quite clear.

This is a real change then from the thread where Thida said 60,000 would attend... which was reduced to 10,000 in a subsequent thread...

now the estimation for the Red Shirt Rally is down to under 5 in attendance.

I see this morning that Thida is reiterating her claim that 60,000 will attend today's Red Rally.

As that's a bit more than Jatuporn is allowed (5), we might see him violating his bail condition.

Red Shirt Leader Jatuporn Prompan, since he appeared on stage during the Red Shirt rally today, would seem to have broken his conditional bail.

BUT.... the Red Shirt Lawyer Karom Polthaklang has said that Jatuporn's participation in the rally did not constitute a violation of a bail condition because his speech was not related to the case. :huh:

ok, he's a lawyer... he's gotta say something.

Now, now, that's hardly fair, buchholz. This was a rally event to commemorate deaths in April/May (depending on who you ask red-shirts only, or all including police/army). This has nothing at all to do with politics. Even the phone-in of k. Thaksin was not political, just a 'happy newyear' message and all the best and freedom, democracy, etc., etc. for you all, while flying across Europe.

Mind you, it seems k. Jatuporn was a bit at it again saying something like "You can kill people, you can jail me, but the people will win in the end." Well at least this time he didn't offer his last drop of blood, only that of others again it seems ;)

They should have nailed Jatuporn on his previous violence and charges stemming from 2009 to revoke his bail, citing his actions in 2010. This time I hope he joins Weng and the rest.

Thida showed today that she doesn't carry any weight with major UDD factions and it left many people wondering where the reds can go from here. No leadership, no money for the masses, and the Dems actually getting some good press about the things they have been doing could marginalize the reds even further. Leaving of course --- only the tactics from Mao's "little red book" and I am sure Weng and his wife don't need a copy handy to quote from.

Court Unopposed to Red-shirt MP Joining Rally

The Criminal Court has stated the participation in yesterday's political gathering by red-shirt leader and Pheu Thai MP Jatuporn Prompan is not a violation of his bail conditions.

Deputy Chief Judge of the Criminal Court Manit Suk-anan stated the participation in yesterday's red-shirt rally by Pheu Thai MP Jatuporn Prompan did not violate the court's conditions for his bail.

Manit said Jatuporn's constitutional right allows him to take part in a rally, but the ban on his taking part in a gathering of more than five people is applicable to an incident that would affect the terrorism case against him.

However, the court still has to review Jatuporn's speech on the red-shirt stage.

The deputy chief judge is certain there will be individuals who will request Jatuporn's bail revocation if his speech is deemed damaging to the terrorism case against him.

He added the court itself can revoke Jatuporn's bail if it finds that he has violated his bail conditions in his speech.

If a poster came on this thread and put the same pronouncements across as some of the judiciary and government spokespeople have done regarding Jatuporn's legal situation and the right to demonstrate, the right-wing obsessives around here would immediately label them a redshirt supporter.

Feeling a tad marginal yet, redshirt-haters?

Today, the Department of Special Investigation (DSI) has again requested that Jatuporn's bail be withdrawn.

This is based upon violating his bail conditions after the last Red Shirt rally.

A decision by the Criminal Court is expected this afternoon.
