i met my thai wife on thai love links this time last year . I have traveled 3 times and each time had a visitor visa refused . 3rd time i traveled to see her we married in bangkok .i am returning for 1 month in February till march . This time i am thinking of using a agent starworldvisa who promise a no win no fee service . pay 30000 when we get the visa . What i would like is some advice . possible help or a better price than 30000 baht . is it possible for a agent to 100% get visa ? last 3 visitor visas we failed due too 1st

only just met , 2nd still not enough evidence relationship and the last time we fail due to communication problems and forms in different languages . the place where we marry put on the form we were living together 1 year . this is un true so we failed the 3rd visa please help us

Whether or not to use an agent is a personal choice. As is which agent to use.

However, before making any commitment to a particular agent, I'd suggest that you read this topic.

The answer is a definite no. Agents are not involved in the decision making process and no agent has any influence whatsoever over the entry clearance officers who do make the decision. If an agent claims otherwise, they are lying.

What an agent does is help and advise the applicant on presenting the best application possible. Many agents will offer a 'no visa, no fee' service, but this does not guarantee a visa.

This could be a problem. Using false information in a visa application, even without the applicant's knowledge, is a guarantee of refusal and could cause problems with future applications; possibly a 10 year ban from visiting the UK! Although this wouldn't be the case if she were applying for settlement as your wife.

However, even if she is applying for settlement you must explain the reason for this false information appearing in her last visit application.

Do your own visa , it can be done its not that hard, many people on this site has done it , all an Agent will do is fill your application in . Don't believe No visa no pay.Just to submit your visa application will cost you ,Its there are no guarantees, every visa is Judged on its own merit, You should not lie because they do 1000 of visa applications, You should have Photos of yourself and your lady to submit , more the better, but not in the same cloths.The language is not a problem just fill the forms in with English you do not need translations.Have you got your reason for refusal, or do you think that you failed because you told lies. There are many people on here with far more knoledge than me . just do your home work before you try again.

The applicant has to arrange their own English test. If they pass they will be given a pass certificate which they include in their visa application. You can, of course, arrange the test for your wife.

The test must be taken with one of the UKBA approved providers, and a list of those in Thailand can be found by clicking here.

Prices vary, so you may want to shop around.

The above assumes that you are asking about the UK, and you will see that I have amended your topic title to include 'UK' on this assumption. If not the UK, please say which country.

thank you for all your help the lie was a mistake made by register office in bangkok i never spotted it because it was in thai

IMHO, the aplication is made by your wife for a visa, not you and as she is Thai then she should have spotted it, I suppose the big sin is if she said herself that you had been living together for a year before you tied the knot, when your passport tells a diferent story.

Indeed.

In her previous applications she would have signed a declaration to say that the information provided was true. Yes, this declaration is in English but you should have made sure that she understood it before she signed it. The ECO wont accept that she signed it without knowing what it contained. This means that any subsequent application should be refused for a period of up to 10 years.

However, as I said previously, as she is now applying for settlement Para 320(7C)(a )(ii) of the immigration rules says that the above 'ban' does not apply if one is making an application as a spouse, civil partner or unmarried or same-sex partner.

But she should still explain in this application why the previous one contained false information.

I would suggest in your case to use a good agent, personally we used Siam Legal in Bangkok and they did more than just fill in the application form. I am sure the likes of Visa Plus and others on her would tell you the same. I collated as much evidence as I could, my wife did the same and our agents put everything together properly and in an acceptable order. I was also advised about a supporting letter which I had forgotten about. What an agent does is make sure that you submit everything possible that will help your application. It is also important to tell your agent everything truthfully and I am sure this is your best course of action in my opinion

Good luck and any work you do now is well worth it once you have your wife back in the UK

There are several points worth picking up on in your post. Firstly, using an agent offering " no visa, no fee ". Be careful, and be sure to read the small print. There is one agent in Pattaya advertising " no visa, no fee". The small print states that they require a non-refundable "under any circumstances" deposit of 70%. Unfortunately they don't say what their fee is, so you don't know what you are paying 70% of until you walk through their door! So, the most you are going to get back under that "no visa, no fee " policy is 30%. We publish our fee on our website ( currently 28,000 baht for a settlement visa) but we are based in Pattaya. We normally require a deposit of 10,000 baht which is non-refundable. The balance will be refunded if the visa is refused, or we will re-submit a new application at no extra cost. Very few agents actually publish their fees, although I know a couple who do.

I have not heard of Starworldvisa, but I have just had a look at their website. They appear to be a Thai run company as their English page appears to be a poor quality translation of their home page. It is probably a computer translation. It looked like their fees are between $500 - $2000, but I may be wrong.

All of the posts concerning your last refusal are correct. The fact that it appears that deception was employed ( having said that you lived together for one year ) could mean a visa application ban for your girlfriend of up to 10 years, but not in a settlement spouse application. However, as 7x7 says, you will have to explain exactly what happened with that application, and why your girfriend said you lived together. I don't actually understand your post where it says that it was a mistake by the register office. Was the mistake made at the register office or on the visa application form ?

We can also arrange the A1 level English test for your wife with English Test Centres, either in Pattaya or Bangkok. I agree with your comments, and Siam Legal is one of the companies that does publish it's fees on their website. They currently charge 650 GBP for a UK spouse visa ( around 31,000 baht ), and they have a good reputation. I'm not sure how, or if, they fit in with 7x7's recommended visa agents as they are not OISC registered ( nor are we, by the way ). OISC registration is required by visa agencies giving visa information in the UK, not in Thailand.

As 7by 7 has pointed out , because they are applying for a settlement visa they can try again Without prejudices from there last attempt, So They can do it them selfs just make certain that you do not fabricate any thing.
